المستخلص: عنوان البحث: "الروايات المتعارضة عن الإمام مالك في مسائل الجنايات والحدود، جمعا ودراسة". وهو مشتمل على مقدمة، وتمهيد، وأربعة فصول، وخاتمة. المقدمة فيها الافتتاحية، وبيان أهمية الموضوع، وأسباب اختياره، والدراسات السابقة، وخطة البحث، ومنهجه. والتمهيد فيه التعريف بالإمام مالك رحمه الله ومذهبه، والتعريف بالتعارض وبالروايات المتعارضة وموقف المالكية في دفعه. أما الفصول الأربعة: فالأول: في المسائل الفقهية المتعلقة بالقصاص في الجنايات في النفس وفيما دون النفس، والثاني: في المسائل الفقهية المتعلقة بالديات في النفس والأطراف، والثالث: المسائل الفقهية المتعلقة بالقسامة، والرابع: المسائل الفقهية المتعلقة بالجنايات الموجبة للعقوبات. والخاتمة فيها بيان أهم النتائج والتوصيات.
أهمية البحث: تتجلى أهمية البحث في أهمية موضوعه وهو الفقه الإسلامي، وهو من أهم العلوم وأشرفها، وكونه متعلقا بدراسة روايات فقهية لشخصية ذات مكانة علمية كبرى، وهو الإمام مالك -رحمه الله، كما أنه ينمي الملكة الفقهية لطلاب العلم، ويسهم في خدمة الفقه المالكي، من حيث بيان طرق وأوجه الجمع عند علماء المالكية بين الروايات المتعارضة عن إمامهم.
هدف البحث: تهدف هذه الدراسة إلى حصر تلك الروايات المتعارضة عن الإمام مالك، وبيان أسباب وقوع هذا التعارض، ومسالك علماء المالكية في دفع هذا التعارض الواقع، أو المتوقع، مع دراسة تلك الروايات دراسةً فقهية موازنة، خدمة لمذهب الإمام مالك -رحمه الله-.
منهج البحث: سلكت في بحثي المنهج الاستقرائي التحليلي من خلال: جمع الروايات المتعارضة من كتب المذهب المالكي، وبيان وجه التعارض بين تلك الروايات، ودراستها دراسة فقهية بذكر الأدلة ومناقشتها، وبيان موقف علماء المالكية منها، ومن ثم بيان الراجح من تلك الروايات حسب المعتمد في المذهب عند المالكية.
نتائج البحث: أن الروايات الفقهية متعددة وكثيرة في عدد كبير من المسائل الفقهية وأن علماء المالكية اهتموا بتلك الروايات، فبينوها ودرسوها، وذلك بالجمع بين تلك الروايات، أو بترجيح الراجح منها حسب الأدلة، وموقف الترجيح هو أكثر ما سلكه المالكية في دفع التعارض.
Abstract: Research title: “Conflicting narrations from Imam Malik on matters of crimes and punishments, collection and study.” It includes an introduction, a preface, four chapters, and a conclusion. The introduction includes the opening, an explanation of the importance of the topic, the reasons for choosing it, previous studies, the research plan, and its methodology. The introduction contains an introduction to Imam Malik, may God have mercy on him, and his doctrine, and an introduction to the contradiction and conflicting narrations, and the position of the Malikis in defending him. As for the four chapters: the first: on the jurisprudential issues related to retaliation for crimes committed against the soul and without the soul, the second: on the jurisprudential issues related to blood money for the soul and limbs, the third: the jurisprudential issues related to retaliation, and the fourth: the jurisprudential issues related to felonies requiring punishment. The conclusion contains a statement of the most important results and recommendations.
The importance of the research: The importance of the research is evident in the importance of its subject, which is Islamic jurisprudence, which is one of the most important and honorable sciences, and the fact that it is related to the study of jurisprudential narratives by a person of great scholarly stature, namely Imam Malik - may God have mercy on him. It also develops the jurisprudential ability of students of knowledge, and contributes to the service of Maliki jurisprudence. In terms of explaining the ways and aspects of combining, according to Maliki scholars, the conflicting narratives about their imam.
Research objective: This study aims to limit these conflicting narrations about Imam Malik, and explain the reasons for the occurrence of this contradiction, and the methods of Maliki scholars in refuting this actual or expected contradiction, while studying these narrations as a balancing jurisprudential study, in service of the doctrine of Imam Malik - may God have mercy on him.
Research Methodology: In my research, I followed the inductive and analytical method by: collecting conflicting narrations from the books of the Maliki school of thought, showing the face of the contradiction between those narrations, studying them in a jurisprudential study by mentioning and discussing the evidence, and stating the position of the Maliki scholars on them, and then stating the most correct of those narrations according to what is approved in The Maliki doctrine.
Research results: The jurisprudential narrations are numerous and numerous in a large number of jurisprudential issues, and that the Maliki scholars paid attention to those narrations, so they clarified and studied them, by combining those narrations, or by giving preference to the more correct of them according to the evidence, and the position of preponderance is what the Malikis took most of in repelling the contradiction
