المستخلص: الحمد لله والصلاة والسلام على أشرف الأنبياء والمرسلين، نبينا محمد وعلى آله وصحبه أجمعين، وبعد.
فإن هذا البحث هو دراسة للمسائل القضائية من خلال تراجم الإمام مالك -رحمه الله- في موطأه، وقد اشتمل البحث على: مقدمة، وتمهيد، وتسعة مباحث، وخاتمة، وفهارس علمية، واشتملت المقدمة على: الافتتاحية، والأهمية العلمية للموضوع، وأسباب اختياره، والدراسات السابقة، وتقسيم المشروع (خطة البحث)، والمنهج المتبع في البحث.
وأما التمهيد فقد بينت فيه مفردات العنوان، وترجمة الإمام مالك -رحمه الله-، ودراسة كتابه الموطأ، ثم أتبعتها بالمباحث التسعة، والتي تتضمن : الترغيب في القضاء بالحق، والشهادات، والقضاء في شهادة المحدود، والقضاء باليمين مع الشاهد، والقضاء فيمن هلك وله دين وعليه دين له فيه شاهد واحد، والقضاء في الدعوى، والقضاء في شهادة الصبيان، وما جاء في الحنث على منبر النبي ﷺ، وجامع ما جاء في اليمين على المنبر .
ثم ختمت البحث بأهم النتائج والتوصيات، ثم الفهارس العلمية .
كما كشف البحث عن أهمية علم القضاء وعناية العلماء بهذا العلم الجليل قديماً، وحديثاً، وحاجة الناس إليه .
وبذلت قصارى جهدي في دراسة المسائل وتحريرها، وفق المنهج العلمي المتبع في الجامعة الإسلامية، كما هو موضح في دليل إعداد الرسائل العلمية والمشروعات البحثية بالجامعة.
وأسأل الله الإعانة والتوفيق والسداد وصلى الله وسلم على نبينا محمد وعلى آله وصحبه أجمعين
Abstract: All praise is due to Allah whose endowments are countless, prayers and peace be upon the most honorable of the prophets and messengers, our Prophet Muhammad, his family and all his companions.
This research is conducted to study the judicial issues through the titles of Imam Malik- May Allah SWT have mercy on him- written in his Muwatta. The research includes a introduction, preface, nine research topics, conclusion, and literary indexes.
First, the introduction included an opening statement, the scholarly importance of the subject, the reasons for choosing it, previous studies, the project division (research plan) and the methodology used in the research.
Secondly, in the preface, I have written down the word-by-word meanings of the titles, and the subheadings of the Muwatta of Imam Malik - may Allah have mercy on him, and a study of his book, then I followed it with the research topics: encouragement to apply justice by the Truth, witnesses in an Islamic court, taking the testimony of one upon whom Hadd (Islamic legal penalty) is due, the case of taking testimony from a witness by (Islamic) oath, administration of justice for one who has passed away, is owed debt and is indebted to someone based on a single witness, using a prepubescent’s testimony, hanth , and a compilation of all narrations regarding taking oath upon the pulpit.
Finally, I concluded the paper with the most important findings and recommendations, and the scientific indexes.
The research also explains the importance of judicial knowledge and the scholars’ concern about this great knowledge, ancient and modern, and the people's need for it.
Last but not the least, I did my best and finest to study the issues well and edit them according to the Islamic methodology followed at the Islamic University as shown in the guide for preparing scholarly theses and research projects at the university.
