المستخلص: هذه رسالة علمية مقدمة لنيل درجة العالمية (الماجستير) في الدراسات القضائية في الجامعة الإسلامية بالمدينة المنورة بكلية الأنظمة والدراسات القضائية بعنوان (شرح عماد الرضا ببيان أدب القضا المسمى: فتح الرؤوف القادر لهذا العاجز القاصر) تأليف المناوي، من بداية مسألة (لو أقام المدعي بينة بما ادعاه...) من نسخة الأصل إلى نهاية قوله: (فيلزم زوجها الإذن لها) من نسخة الأصل، دراسةً، وتحقيقاً وقد اعتمدت في تحقيق هذا الجزء على نسخة مكتبة الجامعة الإسلامية بالمدينة المنورة، وهي المعتمدة هنا كالأصل، وفي المقابلة، اعتمدت على نسخة مكتبة الأزهر بمصر، وتكملهما النسخة الثالثة بمكتبة الحرم المكي. قسمت المشروع البحثي إلى مقدمة، وقسمين، وفهارس فنية، وفيما يأتي بيان ذلك: القسم الأول: فيه أربعة مباحث: الأول: التعريف بالمؤلف، والثاني: التعريف بكتابه، والثالث: التعريف بالشارح، والرابع: التعريف بكتابه. القسم الثاني: النص المحقق، وهو يشتمل على تحقيق بعض المسائل، من كتاب الدعوى والبينات، من بداية مسألة: "لو أقام المدعي بينة، بما ادعاه فليس للمدعى عليه تحليفه" ..... كما يشتمل على تحقيق جزء من بداية "الفصل الثامن في الشهادات" من شروط الشاهد وبيان الكبائر والصغائر من الذنوب والاستبراء منها والعدد والذكورة وبيان قبول الشهادة وردها، وأسباب القبول والرد والمواضع التي لاتقبل الشهادة فيها إلا مفسرةً ومبينةً للسبب إلى نهاية قول المؤلف: "فيلزم الزوج الاذن لها" من (مسألةٌ) "إذا قال إنسان للقاضي: "لي عند فلان شهادة، وهو ممتنع من أدائها مطلقاً، أو لأخذ الأجرة فأحضره ليشهد لم يجبه؛ لأنه فاسق". وختمت الرسالة بذكر المصادر والمراجع، ووضع الفهارس اللازمة المتبعة وفق المقرر.

Abstract: This is an academic thesis submitted to obtain a Master's degree in the Faculty of Judicial Systems Studies at the International Islamic University of Madinah in the Department of Law and Judicial Studies. I have titled this thesis: “Sharh Imad Ar Rida bibiyaan Adabil Qadaa Almusmma Fath ar Raoof Al Qadir Lihaadhal Aajiz Al Qasir”Aathor the prolific scholar Taa ul-‘Aarifeen al-Munaawi. From the beginning of the “If the claimant establishes his proof”, until the end of the chapter of “Permission of the Husband Being given to the wife.” And my work of this book will comprise of both a study and an authentication. I have based my authentication process of this part of the book on the copy that is present in the library of the Islamic university of Madinah which is the main copy used there and is reliable to the degree of being accepted as the original. For authentication, I utilized the copy at the library in Al-Azhar University in Egypt and further supplemented the authentication process with a third copy from the library in Grand Mosque of Makkah, KSA. I have divided this work into the following: an introduction, two sections, and a table of contents. The first section comprises of 4 chapters: 1) about the author of the original book, 2) about the book itself, 3) about the commentator, 4) about the commentator’s book The second section comprises of the authenticated text, which includes the investigation of certain subject areas, from the beginning of the chapter titled “If the plaintiff establishes evidence for what he claimed, the defendant does not have the right to take an oath” in the section titled “Litigation Cases and Evidence.” Many issues are covered such as “If the opposition flees from the court, hides, refuses to cooperate, is absent, or if the plaintiff is a guardian, trustee, agent, or ancestor.” Additionally, topics covered include: “the conditions of a witness, explanation of major and minor sins, abstaining from them, number of witnesses, their gender, an explanation of the acceptance and rejection of testimony, and the reasons for acceptance and rejection. The last issue covered is the chapter of “permission of the husband being given to the wife.” I then conclude this thesis by mentioning the sources, references, and include a table contents. The entire paper and structure follows the thesis guide provided by the Deanship of Graduate Studies.
