* منهج البحث: اعتمد البحث على المنهج الاستقرائي التحليلي.
* محتوى البحث: انتظم البحث في تمهيد وأربعة فصول، وهي على النحو التالي :
تمهيد: في ترجمة الحافظ العلائي.
الفصل الأول: المؤلفات الأصولية للحافظ العلائي.
الفصل الثاني: المسائل الأصولية التي بحثها في غير كتبه الأصولية.
الفصل الثالث: سمات المنهج الأصولي العام للحافظ العلائي.
الفصل الرابع: الاختيارات الأصولية للحافظ العلائي.
* أبرز نتائج البحث:
- أنَّ الحافظ العلائي : يُعدُّ من كبار فقهاء وأصولي الشافعية، ومن العلماء البارزين المتفنِّنين الَّذين برعوا في مختلف العلوم، وصنَّفوا في شتى الفنون، وكان معظِّما للكتاب والسُّنَّة، ومبجِّلا للسَّلف من الصحابة والتابعين وكبار الأئمة، ومنصفا ومعتذرا للمخالف قبل الموافق، ومع ذلك فقد زلت قدمه في بعض المسائل العقدية، بسبب الوضع السائد في عصره وتأثرا ببعض شيوخه الذين لازمهم.
- وقد كان لنشأته وسط أسرة علمية ومشايخ كبارٍ الأثر البالغ في تكوين شخصيته العلمية الفذة التي بزَّ بها الأقران، وصقل معارفه وسعة اطلاعه وإكسابه القدرة الهائلة على كتابة تلك التصانيف المتنوعة والتي قد جاوز بها مئة مصنف، مع ما تميز به في أسلوبه من المزاوجة بين العناية بالأحاديث والآثار، وبأصول الأئمة وفروعهم؛ تخريجا وتنقيحا ونقدا.
- تميَّز العلائي بإفراد دراسات متخصصة في علم أصول الفقه، فكتب عن أحكام الأداء والقضاء، وعن أحكام الإكراه، وتعريف الصحابي وطرق إثبات الصحبة، وعن حجية قول الصحابي، وعن صيغ العموم، واقتضاء النهي للفساد، وتعارض الأقوال والأفعال، وأحكام الاجتهاد.
- كان حِسُّه ونَفَسُه الأصولي ملازما له؛ فلهذا نجد له تلك المباحثات والتحريرات الأصولية النفيسة في مصنَّفاته الأخرى، حديثية كانت أو فقهية أو لغوية.
- وتجلت عناية العلائي بعلم أصول الفقه بتحريره القواعد الأصولية، واستدلاله على القواعد الأصولية، ودفع التعارض الظاهري، وبيانه للفروق الأصولية، وتخريجه للفروع على الأصول، واستدراكه وتعقبه على الأصوليين، وبيانه للإخلال بالنقل، وعنايته بالمقاصد، والأمثلة الأصولية.
Abstract: Research Subject: This research deals with the collection, study, and care in highlighting the fundamentalist efforts of Hafiz Salah al-Din Khalil bin Kaykaldi al-`Ala'i (d. 761 AH), and an explanation of his additions and choices.
Research Methodology: The research relied on the inductive analytical method.
Research Content: The research was organised into an introduction and four chapters, as follows:
Introduction: The biography of Al-Hafiz Al-`Ala'i.
Chapter One: The authored works by Al-Hafiz Al-`Ala'I on Fundamentals of Jurisprudence.
Chapter Two: The Fundamental Issues that he discussed in other than his books on Fundamentals of Jurisprudence.
Chapter Three: The General Characteristics of the Fundamentalist approach of Al-Hafiz Al-`Ala’i.
Chapter Four: The Fundamentalist Choices of Al-Hafiz Al-`Ala'i.
The most prominent results of the research:
- Al-Hafiz Al-`Ala'i is considered one of the great Shafi`i jurists and fundamentalists, and of the prominent scholars who excelled in various sciences and authored in various fields. He venerated the Book and the Sunnah, revered the predecessors among the Sahabah, Tabi`een, and the great Imams, was fair and sought out excuses for those who disagreed with him, even before those who were in accordance with him. In spite of that, he slipped in some doctrinal issues, caused by the situation prevalent in his era and him being influenced by some of his shaykhs whom he adhered to.
- His upbringing among a scholarly family and major shaykhs had a great impact on the formation of his unique personality with which he surpassed his peers, refined and expanded his knowledge and gave him the tremendous ability to author his various works, which he exceeded a hundred in number, along with that which distinguished him in his style of combining the importance of ahadith and athar (narrations), and the principles of the Imams, deducing, revising and criticizing them.
- Al-`Ala’i was distinguished by conducting specialised studies in the Science Fundamentals of Jurisprudence, so he wrote about the rulings of the judiciary, coercion, the definition of the Sahabi and the methods of establishing companionship, the authoritative saying of the Sahabi, the wordings of generalisation, that prohibition necessitates incorrectness, the contradiction of words and actions, and the rulings of ijtihad (striving).
- His fundamentalist sense and self were inherent to him, which is why we find those valuable fundamentalist discussions and writings in his other works, whether they were based on hadith, jurisprudence or linguistics.
- Al-`Ala'i's importance on the Science of the Fundamentals of Jurisprudence was evident in his writings on fundamentalist principles, his inference on them, his repulsion of apparent contradictions, his deduction of the branches based on the foundations, his corrections and investigations of other fundamentalists, his statement of the violation of the transmitted evidences, his care for the purposes, and the foundational examples.
