المستخلص: هذه رسالة علمية مقدمة لنيل درجة العالمية (الماجستير)، في الجامعة الإسلامية، بالمدينة المنورة، في كلية الشريعة «قسم الفقه».
وهي جزء من مشروع علمي في الفقه على المذهب المالكي بعنوان: الدرر على بعض مسائل المختصر للإمام شرف الدين موسى الطُّخَيْخِي (ت 947 ه)، من بداية قوله: (وجبر وصي، قال ابن بَشير: وهل لغيره جبر المرأة على النكاح) إلى نهاية قوله: (بسوقها أي سوق السلعة) من كتاب البيع -دراسةً وتحقيقاً-.
وقد اعتمدتُ في تحقيق هذا الكتاب على أربع نسخ:
الأولى: وهي الأصل، نسخة مكتبة ليدن بهولندا.
الثانية: للمقابلة: نسخة دار الكتب الوطنية بتونس.
الثالثة: للمقابلة: نسخة المكتبة الأزهرية بمصر.
الرابعة: للمقابلة: نسخة مكتبة أسكوريـال بأسبانيا.
وقد استدعت طريقة التحقيق أن تقسم الرسالة إلى مقدمة، وقسمين، وفهارس فنية:
أولا: صدّرت الكتاب بمقدمة، ثم قسمين، بيانهما كالتالي:
القسم الأول: قسم الدراسة، ويشتمل على أربعة مباحث رئيسية، وتحت كل منها مطالب.
المبحث الأول: التعريف بمؤلف المختصر.
المبحث الثاني: التعريف بكتاب المختصر.
المبحث الثالث: التعريف بمؤلف الدرر.
المبحث الرابع: التعريف بكتاب الدرر.
القسم الثاني: قسم التحقيق، ويشتمل على النص المحقق، وفيه: جزء من كتاب النكاح والبيع.
ثم ختمت الكتاب بوضع ثبت المصادر والمراجع، وعمل الفهارس الفنية اللازمة.
واعتمدتُ في كل ذلك دليل الرسائل العلمية المعتمد من قِبل عمادة الدراسات العليا.
Abstract: This is a scientific thesis submitted to obtain an international degree (Master) at the Islamic University of Medina, in the College of Sharia, department of Jurisprudence. It is part of scientific research project in jurisprudence on the Maliki school of thought entitled “Al-Durar ‘Ala Ba’dhi Masail Al-Mokhtasar” By Imam Sharaf Al-Din Musa Al-Tukhaikhi (died 947 AH), from the beginning of his saying: (The executor can force; Ibn Basher said, is it for others to force the woman to marry?) to the end of his saying: (In its market, i.e.: the market for goods) from the book of sale -study and investigation-.
I relied in the investigation of this book on four copies: First: is the original, copy of the Leiden Library in the Netherlands. Second: as a comparison, the copy of the National Library in Tunisia. Third: as a comparison, the copy of the Al-Azhar Library in Egypt. Fourth: as a comparison, the copy of the Escorial Library in Spain.
The method of investigation requires that the thesis be divided into an introduction, two sections, and technical indexes:
Firstly, I started the book with an introduction followed by two sections as follows: The first section: the study section, and it includes four main topics, and under each topic has sub-topics. The first topic: the author’s biography of the Al-Mokhtasar. The second topic: introduction of the Al-Mokhtasar. The third topic: the author’s biography of the Al-Durar. The fourth topic: introduction of the Al-Durar. The second section: The investigation section, and it includes the verified text. It contains part of the book of marriage and sales.
Then, I concluded the book by providing the sources and references and creating the necessary technical indexes. I followed the guidelines for thesis approved by the Deanship of Postgraduate Studies.
