الاحتمالات الفقهية في كتاب المغني لابن قدامة "من أول كتاب الطهارة إلى آخر كتاب الزكاة" - جمعاً ودراسة

فهذه رسالة مقدمة لنيل درجة العالمية العالية الدكتوراه من قسم الفقه، بكلية الشريعة، بالجامعة الإسلامية، بعنوان: (الاحتمالات الفقهية في كتاب المغني لابن قدامة من أول كتاب الطهارة إلى آخر كتاب الزكاة (جمعًا ودراسة)).
احتوى البحث على: مقدمة، وتمهيد: ويشتمل على التعريف بكتاب المغني، والتعريف بابن قدامة، والتعريف بالاحتمال الفقهي، وأربعة فصول: اشتملت على دراسة الاحتمالات التي ذكرها ابن قدامة في الكتب التالية: الطهارة، والصلاة، والجنائز، والزكاة، وبلغ عدد المسائل مئة وسبعين مسألة، وخاتمة: اشتملت على أهم النتائج والتوصيات، وختمت الرسالة بفهارس علميّة إكمالاً للفائدة، وتسهيلاً للقارئ والباحث.
ومن أهم النتائج التي توصل إليها الباحث:
- الاحتمالات الفقهية عند علماء الحنابلة، خاصة احتمالات ابن قدامة، أقوال معتبرة في المذهب.
- احتمالات ابن قدامة -رحمه الله- قد تكون معتمد المذهب، وغالبًا ما تكون خلاف المعتمد.
- احتمالات ابن قدامة -رحمه الله- غالبًا ما تكون وجهًا في المذهب، وقد تكون رواية، عن الإمام، أو تخريجًا لبعض علماء المذهب.
- غالب الاحتمالات التي دُرست في البحث، هي للموفق -رحمه الله-، وقد ينقل الموفق عن غيره بعض الاحتمالات، من دون تصريح، وغالبًا ما تكون لأبي الخطاب من كتابه الهداية.
Abstract: This is a dissertation submitted for obtaining a high international doctorate degree from the Department of Jurisprudence, Faculty of Sharia, and Islamic University of Madinah, entitled: (The Jurisprudential Possibilities in the Book of Al-Mughni by Ibn Qudamah from the beginning of the Book of Purification to the end of the Book of Zakat (collected and studied)).
The research included: an introduction and a preface, which includes the introduction of the book Al-Mughni, the introduction of Ibn Qudamah, the definition of the jurisprudential possibility, and four chapters: included a study of the possibilities mentioned by Ibn Qudamah in the following books: purity, prayer, funerals, and zakat. The number of issues studied was one hundred and seventy. The conclusion: included the most important results and recommendations, and the thesis was concluded with scientific indexes to complete the benefit and to facilitate the reader and researcher.
The most important findings of the researcher were as follows:
1- The jurisprudential possibilities of the Hanbali scholars, especially the possibilities of Ibn Qudamah, are considered sayings in the school of thought.
2- The probabilities of Ibn Qudamah - may Allah have mercy on him - may be the approved madhhab, and often they are different from the approved one.
3- The probabilities of Ibn Qudamah - may Allah have mercy on him - are often an opinion in the hanbali school, and they may be a narration, on the authority of the imam, or a result of the study of some scholars of the hanbali school.
4- Most of the possibilities that were studied in this research, were for Al-Ibn Qudamah - may Allah have mercy on him -, and Ibn Qudamah may narrated some possibilities from the others, without declaration , and most of them belong to Abu Al-Khattab from his book Al-Hidaya.
