فهذا البحث دراسة وتحقيق لمخطوط "رسالة الحد والتعزير" لشيخ الإسلام محيي الدين محمد بن إلياس المنتشوي الشهير بجِوي زاده رحمه الله تعالى من بداية المخطوط إلى نهاية الفصل العاشر: (إذا قال رشوته بكذا فعليه رده يقبل البينة كذا هذا).
النسخ التي حقق عليها:
النسخة الأولى (أ) محفوظة في مكتبة السليمانية، رقم الحفظ: 512.
النسخة الثانية (ب) محفوظة في مكتبة ديار بكر، رقم الحفظ: 104/1.
النسخة الثالثة (ط) محفوظة في مكتبة قسطموني للمخطوطات، رقم الحفظ: 387/6.
ويحتوي البحث على قسمين رئيسين:
القسم الأول: قسم الدراسة، ويتضمن ترجمة مؤلف المخطوط، ودراسة عن المخطوط.
والقسم الثاني: تحقيق جزء من المخطوط، من بدايته إلى نهاية الفصل العاشر.
وقد توصلت إلى عدد من النتائج:
1. أهمية الفروق بين الحد والتعزير.
2. عمق المؤلف في كتب المذهب الحنفي.
3. أهمية تعلم القضاة لمباحث الحد والتعزير.
أسأل الله أن يجعل خالصًا لوجهه الكريم، وأن يلهمنا الصواب والسداد.
Abstract: All praise is for Allah, Lord of the creation. May Allah's blessings and peace be upon our Prophet Muhammed, and his family and all his companions.
This thesis is a study and verification of the book:
" Rissalet Al-Had Wa-Taazir" Li Sheikh Al-Islam Mohiuddin Muhammed Ibn Elias Al-Mantashwi Famous for Jewi Zadeh – may Allah have mercy on him -, from the beginning of the manuscript, until the end of chapter ten: " If he said that he bribed him with such, then he must return him, he accepts the evidence as such".
The copies that are verified on:
First copy (A): preserved in Soulaymaneya library, the catalogue number is (512).
Second copy (B): preserved in Diar Baker library, the catalogue number is (104/1).
The third copy (c): preserved in kastamono library, the catalogue number is (387/6).
Theis thesis consists of two main sections: the first section is the study, this includes translation of the manuscript author, a study on the manuscript.
The second section includes the verified text, from beginning of the manuscript until the end of chapter ten.
The researcher reached many conclusions; the most important are:
The first: the importance of the differences between bounds and discretion.
The second: the author delved into the books of the Hanafi school of thought.
The third: the importance of judges learning about investigations of bounds and discretion.
