المستخلص: العنوان: تخريج الفروع على الأصول من خلال كتاب " المستصفى شرح الفقه النافع للإمام أبي البركات النسفي (ت:710هـ) من بداية كتاب الإقرار إلى نهاية الكتاب (جمعًا ودراسة)، رسالة مقدمة لنيل الدرجة العالمية العالية الدكتوراه، والرسالة جزء من مشروع علمي مقدَّم إلى قسم أصول الفقه في كلية الشريعة بالجامعة الإسلامية بالمدينة المنورة.
يعتمد البحث على المنهج الاستقرائي التأصيلي التطبيقي.
- تتمثل أهمية البحث في كونه يربط بين الجانبين: الجانب النظري بتقرير القاعدة الأصولية، والجانب التطبيقي ببيان بعض الفروع المبنية عليها ووجه البناء.
- أن البحث في تخريج الفروع على الأصول يكسب الباحث ملكة علمية ويعينه على تنمية القدرة على سلوك طرق الاستنباط الصحيحة.
- اشتمل البحث على أربعة عشر فصلا تتضمن (٧٤) من القواعد والمسائل الأصولية و(١٣٥) من الفروع الفقهية مخرَّجة عليها مع بيان وجه تخريجها، كما اشتمل على مقدمة وتمهيد فيه تعريف بعنوان البحث تعريفا وافيا، وخاتمة فيها أهمُّ النتائج والتوصيات، وفهارس متعددة تسهِّلُ الوصول إلى قواعد ومسائله ومصطلحاته العلمية.
- أبرز النتائج: اختلاف طريقة الحنفية والجمهور في بيان دلالات الألفاظ وكيفية الاستدلال بها والحكم عليها بالقطع والظن.
- ينقسم مصطلح التخريج عند الأصوليين، والفقهاء أربعة أقسام، هي ما يلي: تخريج الأصول على الأصول، وتخريج الفروع على الفروع، وتخريج الأصول من الفروع، وتخريج الفروع على الأصول، ويتعلَّق بقسم تخريج الفروع على الأصول.
Abstract: Research title: Referencing of jurisprudential offshoot to the fundamentals of jurisprudence through the book “Al-Mustafa Sharh Al-Nafi’ Fiqh by Imam Abu Al-Barakat Al-Nasfi (710 AH) from the beginning of the book of acknowledgment to the end of the book (collection and study), a thesis submitted to obtain a doctorate degree.
The thesis is part of a scientific project submitted to the Department of Fundamentals of Jurisprudence at the Faculty of Sharia at the Islamic University in Madinah.
Research Methodology: The research is based on the applied inductive and inductive method.
The importance of the research.
- This research links the two sides: the theoretical side by deciding the maxims of the fundamentals of jurisprudence, and the application side by explaining some of the branches based on it and the referencing aspect.
- The research in referencing of jurisprudential offshoot to the fundamentals of jurisprudence earns the researcher a scientific faculty and helps him to develop the ability to conduct the correct methods of deduction.
- The research included fourteen chapters that include (74) of the maxims of the fundamentals of jurisprudence and issues and (135) of jurisprudential branches, extracting them with an explanation of the way to extract them، access to the rules، questions and scientific terminology.
The most prominent results.
- The difference in the method of the Hanafis and the public in clarifying the semantics of the words and how to infer them and judge them with certainty and conjecture
- The term the maxims of the fundamentals of jurisprudence is divided into four sections، which are as follows: the referencing of jurisprudential principles to the fundamentals of jurisprudence, the referencing of jurisprudential offshoot to the offshoot of jurisprudence, the referencing of jurisprudential offshoot to the fundamentals of jurisprudence, the referencing of the fundamentals of jurisprudence to the jurisprudential offshoot and related to the section of the referencing of the fundamentals of jurisprudence to the jurisprudential offshoot.
