يعنى هذا البحث: ببيان منهج الإمام الماوردي في تخريج الفروع على الأصول على طريقة الإمام الشافعي ومن تبعه من الشافعية، وقد تكون من مقدمة وأربعة أبواب، وخاتمة، وفهارس علمية.
شملت المقدمة: أهمية الموضوع، وأسباب اختياره، والدراسات السابقة حوله، وخطة البحث، ومنهج البحث.
أما التمهيد: فشمل مدخل إلى تخريج الفروع على الأصول، والتعريف بالإمام الماوردي وبكتابه، ومنهجه.
وأما الأبواب فكانت على النحو التالي:
الباب الأول: تخريج الفروع على الأصول في مباحث الحكم الشرعي، وفيه ثلاثة فصول.
الباب الثاني: تخريج الفروع على الأصول في مباحث الأدلة الشرعية، وفيه فصلان.
الباب الثالث: التخريج على القواعد الأصولية المتعلقة بتقاسيم الأسماء، ومعاني الحروف، ودلالات الألفاظ، والمفاهيم وفيه ثلاثة فصول.
الباب الرابع: تخريج الفروع على الأصول في مباحث الاجتهاد والترجيح، وفيه فصلان.
الخاتمة: وتشمل أهم النتائج والتوصيات التي سجلها الباحث والفهارس العلمية .
وهذه أهم النتائج التي توصل لها الباحث:
من خلال البحث ودراسة المسائل التي درستها اتضح لي علو كعب الإمام الماوردي في الفقه مكانته عند أئمة الشافعية، وقدرته على ربط الفروع بالأصول.
ظهر لي عناية الإمام في الحاوي الكبير بتخريج الفروع على الأصول، وعنايته بإبراز الأصول التي انتبت عليها المسألة الفقهية.
ظهر من خلال البحث ودراسة التخريج الضرورة إلى النظر الأصولي في البحث الفقهي، إذ به يتضح مجال عمل القاعدة الأصولية.
Abstract: Research Title: Extracting offshoot jurisprudence issues from the principles of jurisprudence from "al-Aawi al-Kabeer" of Imam al-Mawardi (Died: 450 AH) - From the Book of Purity and Prayer - Collection and Study.
This research means: explaining the method of Imam al-Mawardi in extracting offshoot jurisprudence issues from the principles of jurisprudence according to the way of Imam Shafi’i and those who followed him amongst the Shafi’i scholars. The thesis consists of the introduction and four chapters, conclusion, and scientific indexes. The introduction included: the importance of the topic, the reasons for its selection, previous studies on it, the research plan, and the research methodology.
The preface: it included an introduction to the extraction of offshoot jurisprudence issues from the principles of jurisprudence, and the biography of Imam Al-Mawardi, his book, and his method. As for the chapters, they were as follows:
Chapter One: Extracting offshoot jurisprudence issues from the principles of jurisprudence on Sharia Judgment issues, and it contains three sections.
Chapter Two: Extracting offshoot jurisprudence issues from the principles of jurisprudence on Sharia Evidence, and it contains two sections.
Chapter Three: Extracting from fundamental rules related to the division of names, meanings of prepositions, semantics of words, and concepts, and it contains three sections.
Chapter Four: Extracting offshoot jurisprudence issues from the principles of jurisprudence on Ijtihad and validation issues, and it contains two sections.
Conclusion: It includes the most important results and recommendations documented by the researcher and scientific indexes.
These are the most important results that the researcher reached:
1. Through the research and study of the issues that I studied, it became clear to me the greatness of Imam al-Mawardi’s jurisprudence and his position among the imams of Shafi’i, and his ability to link offshoot issues with the principles.
2. The imam’s great care appeared in "al-Aawi al-Kabeer" to extract offshoot jurisprudence issues from the principles, and his interest in highlighting the principles on which the jurisprudence was based.
3. It appears to me through research and study of the extraction the necessity of the fundamentalist view in juristic research, as it will make the fundamental principles work clear.
