المستخلص: هذه إشاراتٌ سريعةٌ، وجُمَلٌ مختصرةٌ، ذكرتُ فيها أهم ما تضمنته الرسالة، وبيانها كالآتي: عنوان الرسالة: الحِيَلُ والـمَخَارِجُ فِي الـمَسَائِل القَضَائِيةِ -جَمْعًا وَدِرَاسِةً.
منهج البحث: سلكت في هذا البحث المنهج الوصفي التحليلي، وقد كان على النحو الآتي: المراد بالحيل في هذا البحث؛ ما نص عليه بعض العلماء قديمًا، أو حديثًا أنه حِيلَة، أو احتيال، أو مخرج، أو نحو ذلك، وتكون صحيحة، ومعتبرة شرعاً عندهم، ثم جمعتُ المادة العلمية المبثوثة في كتب الفقه، والقضاء، والقواعد الفقهية، ونحوها من المظان، ورتبتها على حسب أبواب القضاء حسب الإمكان، ثم قمت بدراسة تلك المسائل كالآتي: إذا كانت المسألة من المسائل المتفق عليها، فأذكر حكمها بدليله مع توثيق ذلك من مظانه، وإذا كانت من المسائل المختلف فيها، فإني أقوم بتصويرها، وتحرير محل الخلاف فيها، ثم أذكر مذاهب الفقهاء الأربعة، ومذهب غيرهم من الفقهاء عند الانفراد، وسبب الخلاف، وأدلة المذاهب ومناقشتها، والترجيح مع ذكر مسوغاته، وأختم بذكر تطبيقات قضائية معاصرة للمسائل -إن وجدت-.
تقاسيم البحث: اشتمل هذا البحث على سبعة فصول، الأول: الحيل في أدب القاضي، وفيه مبحثان، والثاني: الحيل في الدعاوى، وفيه تسعة مباحث، والثالث: الحيل في الإقرار، وفيه ستة عشر مبحثًا، والرابع: الحيل في الشهادات، وفيه تسعة عشر مبحثًا، والخامس: الحيل في اليمين، وفيه ستة مباحث، والسادس: الحيل في الصلح، وفيه خمسة مباحث، والسابع: الحيل في الحكم القضائي، وفيه سبعة مباحث.
أهم نتائج البحث: إن فن الحيل من الفنون المهمة، والعلوم الضرورية؛ لما فيه من تخليص العبد من ضائقة ألمت به، أو معضلة حلَّت عليه، فاستعماله للحيل الشرعية توصله إلى طاعة خالقه ومولاه، وتخلصه من المضايق التي يقع فيها.

Research Methodology: In this research, I used the descriptive analytical method, and it was as follows: What is meant by stratagems in this research; what some scholars described as a stratagem, a fraud, a way out, or the like in the past or recent and is correct, and legally approved by them. Then I collected the scientific material scattered in the books of jurisprudence, the judiciary, the rules of jurisprudence, and other similar sources, and arranged it according to the chapters of the judiciary as much as possible.
Then I studied those issues as follows: If the issue is one of the issues agreed upon, then I mention its ruling with its evidence and references from its sources. If it is one of the issues with disagreement, I visualize it and analyze the subject of disagreement in it. I mention the doctrines of the four jurists and the doctrine of other jurists when he has a unique opinion, then the cause of the dispute, the evidence and discussion of the doctrines, and the validation of opinions by mentioning its justifications. I conclude by mentioning contemporary judicial applications of the issues - if any -.
Research Divisions: This research included seven chapters, the first: stratagems in the affidavit of prejudice, and it has two sections. The second: stratagems in lawsuits and it has nine sections, the third: stratagems in confession and it has sixteen sections, and the fourth: stratagems in testimonies and it has nineteen sections. The fifth: stratagems in the right and it has six sections, and the sixth: stratagems in reconciliation and it has five sections, and the seventh: stratagems in judicial judgment and it has seven sections.
The most important results of the research: The art of stratagems is one of the critical arts, and necessary knowledge. Because it frees the people from the distress that befell him or a dilemma that has happened to him, so his use of legal stratagems will lead him to obedience to his Creator and Master and rid him of the hardships in which he might fall.
