هدفت الدراسة إلى تعرف استدراكات الشرّاح الفقهية على العلاّمة الشيخ خليل في مختصره (من بداية باب التدبير إلى نهاية باب الفرائض) جمعا ودراسة، ولتحقيق هذا الهدف استخدم الباحث المنهج الاستقرائي لجمع استدراكات الشراح الفقهية على مختصر خليل وتحليلها وفق المنهج التحليلي، كما قام الباحث بتقسيم هذه الدراسة إلى ستة أبواب؛ قدم لها بفصلين تمهيدي، الباب الأول: في التدبير، الباب الثاني: أحكام المكاتبة، الباب الثالث: في أحكام أمهات الولد، الباب الرابع: في أحكام الولاء، الباب الخامس: في بيان أحكام الوصية، الباب السادس في الفرائض.
وقد توصلت الدراسة إلى عدة نتائج وأهما ما يلي: 1/ إبراز ما قدمه الشيخ خليل - رحمه الله - للمكتبة الإسلامية عامة ولمذهب المالكية خاصة، بجمعه وحصره لكثير من المسائل في مؤلَّف واحد سهل التناول مع صغر الحجم. 2/ إبراز العناوين المسْتَنْبَطة من كلام المصنِّف أو المستدرِك لكل المسائل المستدركة، وذكر مناسبة إيرادها. 3/ بيان وجود الخلاف الفقهية حتى في المذهب الواحد وبيان اجتهاد علماء المذهب في الوصول إلى الحق والصواب وعدم التعصب. 4/ بيان الراجح والمعتمد في المذهب في المسائل التي استدركها شراح المختصر على الشيخ خليل في مختصره وإيضاح دقة نظر الشراح وحسن قصدهم واشتمال كتبهم على الكثير من المسائل والأحكام، والاستدراكات، والتصويبات.
ويوصي الباحث بما يلي: 1/ إجراء دراسات علمية تسهم في خدمة الفقه الإسلامية عامة والمالكية خاصة. 2/ إجراء دراسة علمية مماثلة في كتب الفقهية الأخرى للمذهب المالكي. 3/ حث الباحثين في إجراء الدراسات الفقهية التي تسهم في إثراء المكتبات الإسلامية
Abstract: Corrections of Jurisprudence commentators on Sheikh Khalil through his summary book "From the beginning of the chapter on management to the end of the chapter on obligations" (collecting and studying)
The present study aimed at identifying the corrections of Jurisprudence commentators on Sheikh Khalil, as well as identifying his concise book. The researcher relied on the inductive approach as the research methodology to collect the jurisprudential commentaries on Khalil’s summary and then analyze them scientifically. The research in its general framework consists of an introduction, two chapters, six parts, a conclusion, the results of the research, and the recommendations of the researcher. The first section deals with the rule of Measures in Islam, the second part deals with the rule of signing agreements with slaves, and the third part deals with the rule of mothers, while the fourth part deals with the rule of allegiance, the fifth chapter deals with the rule of advice, and the sixth part deals with the rule inheritance. In conclusion, the study reached several results, the most important of which are the following: That Sheikh Khalil - may Allah have mercy on him - provided the Islamic library in general and the Maliki school in particular a scientific enrichment by collecting and restricting many issues in one book which is small in size and easy to comprehend. Availability of the most prominent headings extracted from the author's talks for all the corrected issues, and mentioned the appropriateness of their presence in the topic. The existence of the jurisprudential difference within the same Madhab(school of thought) and the diligence of the scholars of the Madhab in reaching the truth and not being fanaticism with a private opinion. Clarification of an approved opinion of the Madhab on the issues that were corrected by commentators on Sheikh Khalil in his summary and clarification of the understanding and intent of those commentators and the issues, rulings, and corrections contained in their books. The researcher recommends the following: Conducting scientific studies that contribute to the service of Islamic jurisprudence in general and the Madhab Maliki in particular. Conducting a similar scientific study in other books of the Maliki Madhab of jurisprudence. Urging researchers to conduct jurisprudence studies that contribute to enriching Islamic libraries.
