المستخلص: قدمت هذه الرسالة لنيل درجة الدكتوراه في الاقتصاد الإسلامي من الجامعة الإسلامية بالمدينة المنورة، وهي بعنوان: "تطوير الأوقاف من خلال الدمج، ودوره في تنمية مواردها، في المملكة العربية السعودية، دراسة تطبيقية على شركة مكة للإنشاء والتعمير، في الفترة 1409ه -1438ه، وتهدف الدراسة إلى إبراز أهمية دمج الأوقاف، والدور الذي يمكن أن يسهم به في تطوير الأوقاف، وتنمية مواردها، من خلال دراسة تجربة شركة مكة للإنشاء والتعمير، والتي تعتبر مثالاً للشركات التي قامت على فكرة دمج الأوقاف في رأس مالها، والأثر التي تحقق للأوقاف بعد الدمج، وتتمثل مشكلة الدراسة في مدى فاعلية دمج الأوقاف في المساهمة في تطويرها وتنمية مواردها بالشكل الذي يمكنها من المساهمة في التنمية الاقتصادية والاجتماعية، هذا التساؤل يمثل جوهر المشكلة التي تعالجها الدراسة تطبيقاً على شركة مكة للإنشاء والتعمير، واستخدمت الدراسة المنهج الوصفي التحليلي والمنهج الاستقرائي.
انتظمت الدراسة في فصل تمهيدي وخمسة فصول، تناول الفصل التمهيدي الأطر النظرية المتعلقة بموضوع الدراسة، فيما تطرق الفصل الأول للمفاهيم والقضايا المتعلقة بدمج الأوقاف، وتناول الفصل الثاني الأحكام الشرعية المنظمة لدمج الأوقاف، فيما تناول الفصل الثالث واقع القطاع الوقفي في المملكة العربية السعودية، أما الفصل الرابع فقد عُني بالتعريف بشركة مكة للإنشاء والتعمير، ومؤشراتها المالية، فيما تناول الفصل الخامس دمج الأوقاف في شركة مكة للإنشاء والتعمير، ودوره في تطويرها وتنمية مواردها، وقد توصلت الدراسة إلى جملة من النتائج من أهمها أن دمج الأوقاف الصغيرة والمتعثرة يعتبر أحد الوسائل التي يمكن أن تسهم في تطوير هذه الأوقاف وتنمية مواردها، لتُمكّنها من العمل بكفاءة عالية مالياً واقتصادياً، وأن شركة مكة للإنشاء والتعمير تُعتبر نموذجاً مبتكراً في تطوير الأوقاف وتنمية مواردها، عن طريق دمج الأوقاف الصغيرة والمتعثرة في رأس مالها، وما نتج عن ذلك من ارتفاع قيمتها وزيادة ايراداتها.
وقد تقدمت الدراسة بجملة من التوصيات، منها أهمية استحداث تشريعات تختص بدمج الأوقاف، وترسم السياسات والخطوات الإجرائية لها، كذلك تشكيل لجنة في الهيئة العامة للأوقاف تُعنى بدمج الأوقاف، تقوم بحصر ودراسة الأوقاف المتعثرة والصغيرة، والوقوف على أسباب تعثرها وقلة منفعتها، والنظر في آلية تطبيق الاندماج بينها، واختيار الشكل النظامي المناسب لها، مع التنسيق مع الجهات ذات العلاقة في سبيل إتمام الإجراءات النظامية لذلك.
Abstract: This research was presented to obtain the PhD degree in Islamic Economy from the Islamic University of Madinah with the title “Developing endowments through merging, and its role in developing its resources in Saudi Arabia, an applied study on Makkah Construction & Development Company in beriod 1409 H and 1438 H”. This research aims to highlight the importance of merging endowments and the role it can play in endowments development and developing its recourses along with studying the experiment of Makkah Construction & Development Company which is considered as a examble for those companies established based on merging of endowments in its capital, and the outcome achieved for the endowments after merging. This research is about the extent of effectiveness of merging endowments in contributing to its resources development in a manner that enable it to contribute in economic and social development. This query represents the essence of the problem addressed in this research which is applied on Makkah Construction & Development Company. This research used the descriptive analytical method and the inductive method.
This research consists of an introductory chapter and five chapters, the introductory chapter addresses the theoretical frameworks related to the research subject, whereas the first chapter addresses concepts and issues related to the merging of endowments. The second chapter addresses legal rules regulating the merging of endowments, whereas the third chapter addresses the reality of the endowment sector in Saudi Arabia. As for the fourth chapter, it was meant to introduce Makkah Construction & Development Company and its financial indicators. The fifth chapter addresses the merging of endowments in Makkah Construction & Development Company, and its role in developing its resources. This research concluded to a set of results, the most important of them is that merging small and stumbling endowments is one of the means that can contribute in developing these endowments and its resources, to enable it to work very efficiently financially and economically, and that Makkah Construction & Development Company is considered as an innovative model in developing endowments and its resources, by merging small and stumbling endowments in its capital, which resulted in an increase in its market value and income.
This research has presented a set of recommendations such as developing new legislations related to merging endowments, drawing policies and procedural steps for this, and forming a committee in the General Authority of Endowments responsible for merging endowments to restrict and study stumbling and small endowments and find out the reasons behind its stumble and lack of benefit, and considering a mechanism of applying the merging between them, and choosing the appropriate systemic form for it along with coordination with the relevant authorities in order to complete its formal procedures.
