قسم الباحث الرسالة إلى مقدمة وتمهيد وستة أبواب وخاتمة أما الـمقدمة فقد بين فيها أسباب اختار الـموضوع وخطة البحث ومنهجه فيه وأما التمهيد فذكر فيه دراسة موجزة في عدد من الـمسائل والـمباحث الـمتعلقة بالقسم كالتعريف به ومشروعيته، وأركانه والألفاظ والتراكيب الـمستعملة في القسم النبوي وأغراض القسم من حيث العموم، ومن حيث وروده في الأحاديث النبوية. والباب الأول: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق بالإسلام والإيمان. والباب الثاني: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق ببعض أنواع العبادات. والباب الثالث: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق بالـمعاملات. والباب الرابع: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق بالجهاد، والإمارة. والباب الخامس: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق بالفضائل. والباب السادس: ذكر فيه الأحاديث الواردة في قسم النبي صلى الله عليه وسلم الـمتعلق بالبر والصلة والآداب، والرقائق والزهد والفتن والخاتمة ذكر فيها أهم نتائج البحث، ومنها: ثبوت مشروعية القسم بالكتاب والسنة والإجماع، وأن النبي صلى الله عليه وسلم أقسم بألفاظ كثيرة ومتعددة، وكانت تحمل هذه الألفاظ ما يرشد السامع إلى عظمة الخالق وما يلفت انتباه الحاضر واهتمامه إلى الأحكام الشرعية التي تتناولها، واختيار النبي صلى الله عليه وسلم من ألفاظ القسم التي تناسب الحالة التي قيل فيها القسم، ومنها: "والله"، "والذي نفسي بيده"، "والذي نفس محمد بيده"، "لا ومقلب القلوب"، "والذي بعثني بالحق"، "والذي لا إله غيره"، "ورب محمد"، "ورب الكعبة". وغيرها.
Abstract: The hadiths in which the Prophet swore (Peace be upon him); in the nine books, Al-Bazzar and Aby Ya’la musnads, and the three Mu’jams of Al-Tabarani-collected and studied.
A scholarly dissertation project submitted for a higher international degree (PhD).
The researcher divided the thesis into an introduction, a preface, six chapters and a conclusion. The introduction outlined the reasons for the choice of the subject, the research plan and his approach؛ and the preface mentioned a brief study in a number of issues and investigations related to the swearing such as: its definition and legitimacy, its pillars, the words and compositions used in the prophetic swearing, the purposes of the swearing in general, and in terms of its mention in the prophetic hadiths.
The first chapter mentions the hadiths mentioned in the Prophet's swearing which related to Islam and faith.
The second chapter mentions the hadiths mentioned in the Prophet's swearing which related to some types of worship.
The third chapter mentions the hadiths mentioned in the Prophet's swearing which related to transactions.
And the fourth chapter mentions the hadiths mentioned in the Prophet's swearing which related to jihad and the emirate.
And the fifth chapter mentions the hadiths mentioned in the Prophet's swearing which related to virtues.
And the sixth chapter mentions the hadiths mentioned in the Prophet's swearing which related to righteousness, relationship, morals, asceticism and temptations.
The conclusion mentioning the most important findings of the research, including: proving the legitimacy of the Swearing in the Book, Sunnah and Consensus, and that the Prophet (pbuh) swore in many and multiple words, in which these words, carried what led the listener to the greatness of the Creator, and what draws his attention to the islamic provisions that deal with it, and the choice of the Prophet peace be upon him from the words of the swearing that fit the situation in which the oath was said, including:
“By Allah, By the One in Whose hands is my soul, By Him in whose hand Muhammad's soul is, No, by Him who overturns the hearts, By Him who sent me with the truth, By Allah,other than Whom is no God, By the Lord of Mohammad, By the Lord of Ka’bah”. and other else.
