موضوع البحث: عُنِيَ البحث بجمع الاختيارات الفقهية للإمام أبي إسحاق التُّونسي من الكتب المختلفة، ودراستها دراسةً فقهيةً مقارنةً داخل المذهب المالكي وخارجه مع بقيَّة المذاهب الثلاثة المشهورة وغيرها إن وُجِد.
منهج البحث: المنهج الاستقرائي التحليلي لدراسة المسائل، ويشتمل البحث على مقدمة، وتمهيد، وخمسة فصول، وخاتمة.
أما المقدِّمة وتشتمل على أهميَّة الموضوع، وأسباب إختياره، والدِّراسات السَّابقة، والخطَّة إجمالًا، والمنهج المتَّبع، فالشُّكر والتَّقدير.
وأمَّا التَّمهيد فذكرت فيه ترجمة الإمام أبي إسحاق التُّونسي :.
وأمَّا الفصول فقد ذكرت تحت كلِّ فصلٍ من الأربعة الأولى ثلاثة مباحث، والفصل الأخير ذكرت فيه مبحثًا واحدًا، تحت هذه المباحث عدَّة مطالب هي عناوين لمسائل، قد بلغ عددها (84) مسألةً، بدأت بتصوير المسألة إن احْتِيج لذلك، فتحرير محلِّ النِّزاع، ثمَّ ذكر إختيار أبي إسحاق التُّونسي : مختصرًا وتوثيقه من مصادره، ثمَّ تحرير الأقوال المعتمدة في المسألة مع إيراد الأدلَّة، ثمَّ المناقشات إن وُجِدَت، ومِنْ ثَمَّ ترجبح ما تبيَّن لي أنَّه الأقرب للصَّواب، مع ذكر سبب الخلاف وثمرته إن وُجِدَا.
ثمَّ خاتمة وتشتمل على أبرز النتائج التي توصَّلت إليها وبعض التَّوصيات ثمَّ الفهارس.
وقد تبيَّن لي من خلال هذا العمل أنَّ الإمام أبا إسحاق التونسي : شخصيَّة مجتهدة معتنية بالدَّليل، بعيد عن التَّعصب المذهبي والجمود الفقهي، يتَّبع ما يعتقد أنَّه حقٌّ ولو خالف قول الإمام مالك : أو المعتمد في المذهب.
Abstract: Research Title: "Jurisprudence Choices of Imam Abu Ishaq Ibrahim bin Hassan Al-Tunisi Al-Maliki, may God have mercy on him (Died:443HJ) from the beginning of book of foreclosure till the end of book of will" - collection and study.
Research Subject:This research is written to collect Jurisprudence choices of Imam Abu Ishaq Al-Tunisi from various books and to study them in a doctrinal, comparative study to and outside the Maliki school and with the three other famous school and others, if any
Research Method: The inductive analytical approach to studying issues. The research includes an introduction, a preface, five chapters, and a conclusion.
The introduction: includes the importance of the topic, the reasons for choosing it, previous studies, the plan as a whole, the methodology followed, thanks, and appreciation.
As for the preface: I mentioned the translation of Imam Abu Ishaq Al-Tunisi, may God have mercy on him.
As for the chapters: under each of the first four chapters, three topics were mentioned, and the last chapter in which I said one case, under these sections several demands are addresses of issues, the number of which has reached (84) points, which I began to photograph the case if it is needed, so editing the subject of the dispute. I mentioned the selection of Abu Ishaq Al-Tunisi, may God have mercy on him briefly and documenting it from his sources, then edited the approved sayings on the issue with evidence. Discussions, if any, and then weighing what I found out to be the closest to the right, mentioning the reason for the disagreement and its fruit, if any.
Conclusion: then includes the most prominent results reached, some recommendations, and then indexes.
I deduced from this work that Imam Abu Ishak Al-Tunisi is a hardworking personality who takes care about the proof, far from doctrinal intolerance and juristic rigidity, follows what he thinks that is the truth even if it is different from Imam Malik's opinion or what is adopted in his doctorine.
