محتويات البحث: تناولت موضوع البحث خلال مقدمة وفصل تمهيدي وثلاثة أبواب وخاتمة، تناولت في الفصل التمهيدي بيان المصطلحات الخاصة بالبحث، وتناول في الباب الأول أركان الجريمة العابرة للحدود وأساس وصفها وطبيعتها وعلاقتها بالجرائم الأخرى، وتناولت في الباب الثاني طرق مكافحة الجريمة العابرة للحدود في النظام السعودي والقانون الدولي، أما الباب الثالث فقد تناولت خلاله الإجراءات المتبعة في تسليم مرتكبي الجرائم العابرة للحدود ومحاكمتهم والعقوبات المقررة لهذه الجرائم.
نتائج البحث: إن مصطلح الجريمة العابرة للحدود ما زال غامضاً، والاختلاف عليه ما زال قائماً، إذا لم يتوصل المجتمع الدولي حتى وقتنا الحاضر إلى وضع تعريف متفق عليه بين جميع الدول، وتعد الجريمة العابرة للحدود من أهم المواضيع المطروحة على بساط البحث العلمي، ذلك نظراً لمخاطر أنشطتها على أمن المجتمعات واستقرارها وتدميرها للموارد الاقتصادية مما يعيق التنمية الاقتصادية للدول التي تقع في إقليمها، كما إن مخاطرها لم تعد محصورة في دولة معينة بل إن أنشطتها أصبحت تمتد عبر مختلف الدول دون احترام لسيادة هذه الدول مما يستلزم التعاون المشترك لمنعها ومكافحتها، ومن الصعوبة بمكان وضع قائمة شاملة تتضمن جميع أنشطة الجريمة العابرة للحدود، لأن المنظمات الإجرامية تمارس مختلف الأنشطة الإجرامية التي تحقق أكبر قدر ممكن من الأرباح، وتعتبر جريمة غسل الأموال القذرة، وجريمة الإرهاب، وتداول المخدرات والاتجار في الأشخاص، من أهم وأبرز صور وأشكال الجريمة العابرة للحدود، ويوجد جهود دولية مبذولة في سبل مكافحة الجريمة العابرة للحدود، سواء على مستوي المؤتمرات أو الاتفاقيات واللجان التي تتم برعاية الأمم المتحدة، وكذلك لا يخفي دور الشرطة الجنائية الدولية (الانتربول) التي تبذل جهوداً مهمة وفعالة في مكافحة الجريمة العابرة للحدود.
وقد قدمت الدراسة مجموعة من التوصيات في هذا الشأن.
Abstract: Research title: Ways to combat transnational crimes in Saudi Arabia and international law (comparative study).
Research Methodology: in this study, I followed the comparative, analytic, analytic approach.
The research contents: The subject of the research was discussed in an introduction, an introductory chapter, three sections and a conclusion, which dealt in the introductory chapter with the statement of terminology concerning the research, and in Part I with the elements of cross-border crime, its description, nature and relation to other crimes, and in Part II dealt with ways of combating transnational crime in the Saudi regime and international law. Part three dealt with the procedures for the extradition, prosecution and punishment of transnational crimes.
Research results: The term transboundary crime remains vague and the difference is still present, if the international community has not yet reached an agreed definition among all States, and transnational crime is one of the most important subjects on scientific research. Because of the risks of their activities to the security, stability and destruction of societies and economic resources, which hinder the economic development of States in their territory, the risks are no longer confined to a particular State, but their activities extend across different States without respect for the sovereignty of those States, which necessitates joint cooperation to prevent and combat them. It is very difficult to draw up a comprehensive list of all cross-border crime activities, since criminal organizations carry out various criminal activities that maximize profits
This study aims to find out how to combat cross-border crime in the Saudi system in comparison with international law, and accordingly the study was divided into an introduction, a preliminary chapter, and three sections. The crime of money-laundering, the crime of terrorism, drug trafficking and trafficking in persons are among the most important and prominent images and forms of cross-border crime, and there are international efforts in ways to combat transnational crime, both at the level of United Nations-sponsored conferences, conventions and commissions. The role of the International Criminal Police (Interpol), which is making important and effective efforts in combating transnational crime, is also not hidden.
The study made a series of recommendations in this regard.
