فكرة الموضوع: بيان استدراك من جاء بعد الإمامين الرافعي والنووي رحمهما الله من فقهاء الشافعية، ودراسة المسألة دراسة فقهية مقارنة بذكر أقوال الفقهاء وأدلتهم، ثم بيان المعتمد في المذهب من خلال الأصول المعتمدة في المذهب في بيان الراجح من الأقوال.
خطة البحث: يشتمل البحث على مقدمة، وتمهيد، وسبعة فصول، وخاتمة، وفهارس.
أما المقدمة فتتضمن: الافتتاحية، وأهمية الموضوع وأسباب اختياره، والدراسات السابقة، وخطة البحث، ومنهجه.
وأما التمهيد: فيتضمن دراسة عن الإمامين الرافعي والنووي، وبيان منهج الشافعية في المعتمد من المذهب.
والفصول السبعة هي: الفصل الأول النفقات والحضانة، والثاني: الجراح والديات والحكومات، الثالث: دعوى الدم والقسامة، الرابع: الحدود، الخامس: الضمان والصيال، السادس: السير وأحكام أهل الذمة، السابع: الصيد والذبائح والأضحية.
نتائج البحث:
أولا: المذهب الشافعي من أكثر المذاهب الفقهية خدمة، وأسهلها من حيث الوصول إلى المعتمد في المذهب، ففيه قواعد مقعدة لبيان الراجح من الأقوال عند اختلاف فقهاء الشافعية.
ثانيا: ليس المعتمد دائما هو ما ذهب إليه الرافعي والنووي رحمهما الله، فتارة يكون المعتمد ما ذهب إليه من بعده من فقهاء المذهب.
Abstract: Reviews and corrections of Shafi'i jurists on Imam Rafii and Al-Nawawi in the approved doctrine, from the beginning of the Expenditure Book to the end of the sacrifice book (collection and study)
The idea of the topic : Explaining the corrections of those who came after the two Imams al-Rafii and al-Nawawi, may Allah have mercy on them among the Shafi’i jurists, and studying the issue jurisprudentially in comparation with mentioning the sayings and evidence of the jurists, then the elucidation of the adopted in the doctrine through the approved principles in the doctrine in showing the most correct of the opinions.
Research Plan: The research includes an introduction, a preface, seven chapters, a conclusion, and indexes.
The introduction includes: the editorial, the importance of the topic and the reasons for choosing it, previous studies, the research plan, and its method.
The preface includes a study on the Imam al-Rafii and al-Nawawi, and a description of the Shafi’i approach in the approved doctrine.
The seven chapters are : the first chapter, expenses and custody, the second : the crimes and punishments , the third : the lawsuit of blood and division, the fourth : the penalties , the fifth : the guarantee, the sixth : the rulings of the people of dhimma, the seventh : hunting, and sacrifice .
Research results:
First: The Shafi’i school is one of the most servicing jurisprudential doctrines, and the easiest in terms of access to the approved doctrine. In it, there are complex rules to indicate the most correct of the opinions when the Shafi’i jurists differ.
Second: It's not always that the approved doctrine is the view of Alnawawai and Al Rafii, Sometimes, the approved doctrine is the views of the scholars of the doctrine after them.
