فإن هذا البحث دراسةٌ وتحقيقٌ لكتاب: «إفادة الأمة بأحكام أهل الذمة» للعلامة: محمد بن إسماعيل الصنعاني (تـ: 1182هـ) ¬ من: (بداية المخطوط) إلى قوله: (انتهى ما أردناه من الجواب، والحمد الله حمداً يدوم بدوام الله تعالى وصلى الله على سيدنا محمد وآله وصحبه وسلم في اللوحة (20/ أ).
ويحتوي البحث على قسمين رئيسين: القسم الأول: قسم الدراسة، ويضمن مبحثين: الأول للتعريف بالعلامة الصنعاني، والثاني: للتعريف بكتاب إفادة الأمة بأحكام أهل الذمة، ويحتوي القسم الثاني على: تحقيق الجزئية المحددة من المخطوط.
وقد توصل الباحث إلى عدد من النتائج أهمها: المكانة العلمية العالية للعلامة الصنعاني، ومنها أن كتاب (إفادة الأمة بأحكام أهل الذمة) من أهم المصادر القضائية لاحتوائه على كثير من المسائل والأحكام المتعلقة بأهل الذمة، ولما فيه من فوائد قضائية مهمة.
Abstract:
Praise be to God, Lord of the Worlds, and peace and blessings of God be upon our Prophet Muhammad: And upon all his family and companions, after this: this research is a study and investigation of the book: “Efadt Al- Ummah by Ahkam Ahl Al-Dhimma” by the scholar: Muhammad bin Ismail Al-Sanaani (who died in 1182 AH) - from: (Beginning of the manuscript) to his saying: (What we wanted of the answer has ended, and praise be to God, that will last forever as long as God Almighty, and may God’s blesing and peace be upon our Master Muhammad, his family and companions, and peace be upon him. The manuscript is in the Panel (20 / A).
The research contains two main parts: the first section: the study section, and it includes two topics: The first is for the definition of the scholar al-Al-Sanaani, and the second topic : is to define the book “Efadt Al- Ummah by Ahkam Ahl Al-Dhimma", and the second section contains the investigation of the specific part of the manuscript.
The researcher has reached a number of results, the most important of which are: The high scientific position of the scholar Al-San`ani, among which is that the book (Efadt Al- Ummah by Ahkam Ahl Al-Dhimma) is one of the most important judicial sources because it contains many issues and rulings related to the people of dhimmah, and for its important judicial benefits. We ask God for success and repayment, and praise be to God, Lord of the worlds.
