المستخلص: هذا ملخص لرسالتي في الدكتوراة والتي بعنوان: تخريج الفروع على الأصول من خلال كتاب: (التعليقة الكبرى شرح مختصر المزني) للقاضي أبي الطيب طاهر بن عبد الله الطبري الشافعي (ت450ه) (من بداية كتاب الظهار إلى نهاية كتاب الديات) (جـمعًا ودراسة).
تقسيم البحث: يتكون البحث من مقدمة، وتمهيد، وثلاثة أبواب، وخاتمة، وفهارس.
المقدمة: وتشمل: الافتتاحية، وأهمية الموضوع, وأسباب اختياره، والدراسات السابقة, وخطة البحث, والمنهج المتبع في كتابته.
التمهيد: وفيه ثلاثة فصول: الفصل الأول: مقدمات تتعلق بتخريج الفروع على الأصول, الفصل الثاني: التعريف بصاحب المتن والشرح, الفصل الثالث: التعريف بكتاب التعليقة الكبرى شرح مختصر المزني.
الباب الأول: تخريج الفروع على الأصول المتعلّقة بالحكم الشرعي, والأدلة, وفيه ثلاثة فصول: الفصل الأول: تخريج الفروع على الأصول في مباحث الحكم الشرعي, الفصل الثاني: تخريج الفروع على الأصول المتعلقة بالأدلة المُتَّفق عليها, الفصل الثالث: تخريج الفروع على الأصول المتعلقة بالأدلَّة المختلف فيها.
الباب الثاني: تخريج الفروع على الأصول المتعلقة بدلالات الألفاظ, وفيه ثلاثة فصول:
الفصل الأول: تخريج الفروع على الأصول المتعلقة بالحقيقة والمجاز, والبيان, ومعاني الحروف, الفصل الثاني: تخريج الفروع على الأصول المتعلقة بالأمر والنهي والعام والخاص, الفصل الثالث: تخريج الفروع على الأصول المتعلقة بالمُطلَق والمقيد, والمفهوم.
الباب الثالث: تخريج الفروع على الأصول المتعلقة بمباحث التعارض والترجيح, وفيه فصلان: الفصل الأول: التخريج على الأصول المتعلقة بترتيب الأدلة والترجيح من جهة الراوي والرواية, الفصل الثاني: التخريج على الأصول المتعلقة بالترجيح من جهة المتن, والترجيح بأمر خارجي.
الخاتمة: وفيها أهم النتائج, والمقترحات
Abstract: This is a summary of my PhD thesis titled: Extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence through the book (al-tahlegha al-kubra , sharh mukhtasar al-mazni ) by Abi al-toyeb taher bin Abdullah al-tabari al-shafiee (dead 450H) (from the beginning of the chapter on purity to the end of the chapter on the blood money) ( collection and study )
Division of the research: The research consists of an introduction, a preface, three chapters, a conclusion, and indexes.
Introduction: and it consist: the opening, the important of the subject, the reason behind choosing it, previous study, research plan, and the applied methodology.
Preface: and it consist of three division: in the first division: introduction concerning extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence, the second division: Introducing the author of the text and commentary, the third division: Introducing the book of (al-tahlegha al-kubra , sharh mukhtasar al-mazni) .
First chapter: extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence on the principles related to Sharia ruling and evidence, and it consist of three divisions: the first division is extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence on the principles in sharia ruling issues, the second division : extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence on the principles related to the agreed evidence , the third division : extraction of offshoot jurisprudence issues from the fundamental principles of jurisprudence on the principles related to evidences disagreed upon .
