المستخلص: تطور مفهوم عمليات القوات الدولية لحفظ السلم والأمن الدوليين في الآونة الأخيرة، وبصفة خاصة مع مطلع العقد التاسع من القرن الماضي، في أعقاب انتهاء الحرب الباردة، تطورا كبيرا ليس فقط بسبب التزايد الكبير والملحوظ في عدد العمليات، وإنـما بالأحرى بسبب امتداد مهامها إلى مجالات وموضوعات جديدة، لم تكن تضطلع بها من قبل، وتختلف بصفة كلية عن وظائفها التقليدية.
ويوفر ميثاق الأمم المتحدة آليات مختلفة لتحقيق حفظ السلم والأمن الدوليين، والتي ينص عليها كل من الفصل السادس والسابع من الميثاق. إذ أن الأول يوفر ما يتخذ من تدابير وآليات لحل النزاعات حلا سلميا فيما بين الدول، كالمفاوضات ونحوها.
أما الثاني فيحتوي على الآليات القسرية التي يمكن استخدامها في حال فشل الآليات السلمية، فإذا ما وجد مجلس الأمن أن ما وقع هو تهديد للسلم أو إخلال به، أو أنه عمل من أعمال العدوان، يمكن أن يباشر الآليات القسرية والتي يكون آخرها استخدام القوة العسكرية.
وتتناول هذه الدراسة (مهام القوات الدولية في حفظ السلم والأمن الدوليين) دراسة تحليلية مقارنة، وجاءت في فصل تمهيدي للتعريف بمصطلحات البحث، وماهية القوات الدولية، وحفظ السلم والأمن. كما تناولت في بابها الأول: الأساس القانوني لإنشاء القوات الدولية وتشكيلها. أما الباب الثاني: فقد تناولت الوضع القانون للقوات الدولية وعملها، ومهامها في حفظ السلم والأمن.
وجاء في نتائج الدراسة بأن القوات الدولية محل اهتمام المجتمع الدولي؛ لأنها ساهمت في تسوية العديد من المنازعات والأزمات الدولية. ويكون على عاتق القوات الدولية بعض الواجبات والالتزامات، منها: احترام قوانين وأنظمة الدول المضيفة، والامتناع عن التدخل في شؤونها الداخلية.
وتوصي الدراسة بتعديل ميثاق الأمم المتحدة، بإضافة فصل جديد بعنوان (عمليات القوات الدولية)، يتوسط الفصلين السادس والسابع. ثم تعد أحكام هذا الفصل هي الأساس القانون، لإنشاء وتنظيم القوات الدولية. كما أنه لا يوجد ما يمنع من قيام كل دولة عضو في الأمم المتحدة، بتخصيص وحدات من قواتها المسلحة، لتشارك مع قوات الدول الأخرى، كقوات دولية لحفظ السلم والأمن الدوليين.
Abstract: The concept of operations of international forces for the maintenance of international peace and security has recently evolved, particularly in the early 1990s, in the aftermath of the end of the cold war, not only because of the significant and significant increase in the number of operations, but rather because of the extension of their functions to new areas and themes. It has never been carried out before, and is totally different from its traditional functions.
The Charter of the United Nations provides various mechanisms for the maintenance of international peace and security, as provided for in Chapter VI and VII of the Charter. The first provides measures and mechanisms for the peaceful settlement of disputes among States, such as negotiations and so on
The second contains coercive mechanisms that can be used in the event of failure of peaceful mechanisms. If the Security Council finds that a threat to or a breach of the peace occurred or an act of aggression, it may initiate coercive mechanisms, the latest of which is the use of military force.
This study (the tasks of the international forces in the maintenance of international peace and security) is a comparative analytical study and came in an introductory chapter to define the terms of research, what are the international forces and the maintenance of peace and security. It also addressed in its first section: the legal basis for the establishment and composition of international forces. The second section deals with the legal status of the international forces and their work, and their tasks in maintaining peace and security.
The results of the study that the international forces of interest to the international community; because they contributed to the settlement of many disputes and international crises. The international forces have some duties and obligations, including: respecting the laws and regulations of host countries, and refraining from interfering in their internal affairs.
The study recommends that the Charter of the United Nations be amended by the addition of a new chapter entitled "International Force Operations", which would be chapters between chapters VI and VII. The provisions of this Chapter shall then be the basis of law, for the establishment and organization of international forces. Nor is there any obstacle for each Member State of the United Nations to allocate units of its armed forces to participate with the forces of other States as international forces for the maintenance of international peace and security.
