المستخلص: تم جمع مسائل هذا البحث من الكتب المعتمدة عند متأخري فقهاء الحنابلة، سواءً نصوا عليها بأحد أدوات الاستثناء، أو أشاروا إليها بلفظ الاستثناء، أو استنبط من كلامهم أنه استثناء. ثم تمت دراسة هذه المسائل ببيان حكم أصل كل مسألة عند الحنابلة، ودليله، ومن وافقهم من العلماء في ذلك، ثم استخراج المستثنيات من تلك الأصول، مع بيان أقوال الحنابلة في المستثنى، والمعتمد في المذهب، وبيان دليل الاستثناء.
ولقد اشتمل البحث على ثلاثة أبواب، وهي كالتالي:
الباب الأول، وقد تضمن ثلاثة فصول: الفصل الأول: مسائل الاستثناء في الطلاق، والفصل الثاني: مسائل الاستثناء في الرجعة، والفصل الثالث: مسائل الاستثناء في الإيلاء.
الباب الثاني، وقد تضمن أربعة فصول: الفصل الأول: مسائل الاستثناء في الظهار، والفصل الثاني: مسائل الاستثناء في اللعان، والفصل الثالث: مسائل الاستثناء في العدد، والفصل الرابع: مسائل الاستثناء في الإحداد.
الباب الثالث، وقد تضمن ثلاثة فصول: الفصل الأول: مسائل الاستثناء في الرضاع، والفصل الثاني: مسائل الاستثناء في النفقات، والفصل الثالث: مسائل الاستثناء في الحضانة.
أبرز نتائج البحث: إن الناظر في المستثنيات الفقيهة يتبيّن له أسرار الشريعة الإسلامية وحكمها، فبالاستثناء تحصل مراعاة مصالح العباد، فاستثنى الشارع ما يوقع العباد في الحرج رحمة بهم.
Abstract: This research has been collected from authentic books of late Hanbali jurists, either by indicating them by one of exception tools, or they indicated them by exception wording, or derived from their speech as exception. These issues have been studied by explaining the verdict of the origin of each issue by Hanbalis, its proof, and who agreed with them among the scholars, then extracting exceptions from those fundamentals, with Hanbalis sayings in these exceptions, and the agreed in the school, and explaining the exception's evidences.
The Research Contains Three Chapters, as follows:
First Chapter: contains three sections: First Section: Exception Questions in Divorce, Second Section: Exception Questions in Retrieving, Section Three: Exception Questions in Shoot.
Second Chapter: Contains four sections, Section One: Exception Questions in Al-Zihar, Second Section: Exception Questions in The Curse, Third Section: Exception Questions in Plurality, Fourth Section: Exception Questions in Mourning
Third Chapter: Contains Three Sections, First Section: Exception Questions in Breastfeeding, Second Section: Exception Questions in Expenses, Third Section: Exception Questions in Nursery.
Most Important Results of the Research: Looking at jurisprudent exceptions we will discover the secrets of Islamic Shariah, and its rules, by exceptions you take care of individuals interests, the legislator (Allah) exempt what is critical for worshippers, as a mercy to them.
