المستخلص: يعنى هذا البحث بدراسة المسائل الفقهية التي اختلف فيها العلماء بسبب اختلافهم في تأويل أحاديث الأحكام، والتأويل له معان متعددة، اقتُصِر في هذا البحث على المعنى المشهور عند المتأخرين من علماء الأصول، وهو: صرف اللفظ عن ظاهره، وتكمن أهمية هذا البحث في أنه يتناول سببا من أهم أسباب الاختلاف بين الفقهاء في المسائل الفقهية، وكذلك يُنَمِّي فقه التماس العذر للعلماء، ومعرفة مآخذهم في الاستدلال، وقد جاء البحث في مقدمة وتمهيد وبابين، وخاتمة، فالباب الأول في المسائل الفقهية المبنية على اختلاف العلماء في تأويل أحاديث الأحكام في العبــــادات، ويتضمن ثلاثة فصول، فصل في الطهارة، وفصل في الصلاة والجنائز، وفصل في الزكاة والصيام والحج، وأما الباب الثاني ففي الأحاديث في غير العبادات، وفيه أربعة فصول: فصل في المعاملات، وفصل في النكاح والطلاق واللعان، وفصل في الجنايات والحدود والجهاد، وفصل في الأطعمة والذبائح والأيمان والنذور والقضاء، وقد بلغت عدة الأحاديث التي اختلف في تأويلها في هذا البحث (283) حديثا، وبلغت التأويلات التي قيلت فيها: (301) تأويل، ومن أهم نتائج هذا البحث: أن أهم أسباب الاختلاف في التأويل هو ظن وجود التعارض، وهذا التعارض له صور متعددة، وأن هناك ضوابط مهمة ينبغي استصحابها عند دراسة مباحث التأويل من أهمها: معرفة أن الأصل حمل النصوص على ظاهرها المتبادر إلى الذهن، وأنه ينبغي جمع روايات الحديث ليتبين من صحة التأويل، وأنه يجب التروي عند تعيين المراد بظاهر النص، وأنه ينبغي معرفة شروط التأويل الصحيح، حتى يكون الحكم على التأويل بناء على هذه الشروط.
Abstract: This Thesis focuses on topics on Islamic Jurisprudence (Fiqh) where there is differences of opinion among scholars as a result of their differences in interpreting prophetic tradition in legal rulings (Ta’weel Hadith Ahkam). Ta’weel has several meanings and definitions. This thesis will be using the definition which is widely accepted by the contemporary jurist (Usul), Which is : Sarf Lafth An Zhahirihi – Understanding the text in its apparent meaning .
This Thesis is Significant as it discusses the causes which lead to differences of opinion among Scholars in Jurisprudence issues. Through this thesis, the reader will appreciate the jurist by understanding the reasons behind their view and opinion.It will also allow the reader to understand and appreciate the reasons by certain mistakes made by the scholars.
These are the most important results of the thesis. Firstly, the most important cause of the differences in interpretation is the perception that contradictions exist between them. These contradictions are of different types. There are also important principles which must be taken into consideration during the study of the subject. Firstly Interpreting the text in its apparent meaning .Secondly it is important to gather the different narrations of prophetic tradition( Hadith text) which will prove its proper interpretations .Thirdly it is important not to rush into conclusion in a particular interpretation where the meaning is apparent. Lastly it is important to understand the conditions for proper interpretations which will allow the interpretations to be judged according to these conditions.
