أما التمهيد: فاحتوى على تعريف موجز بالعموم والخصوص، وأقسام العام، والفرق بينه وبين المطلق، والتخصيص، والتقييد، والنسخ، وحكم العمل بالعام قبل البحث عن المخصص، وحجية العام بعد التخصيص، وأنواع المخصصات، وتناول الباب الأول، مسائل الأيمان، والنذور، والصيد، والأطعمة، واشتمل الباب الثاني على مباحث الأحوال الشخصية من النكاح، والطلاق، والعدة، والإيلاء، والظهار، واللعان، والإحداد، ومسائل المعاملات المالية، وتناول الباب الثالث مسائل الوصايا، والفرائض، والجنايات من القصاص والديات، ومسائل الحدود من حد الزنا، والقذف، والسرقة، وتطرق الباب الرابع إلى مسائل الأقضية والشهادات، ثم توصل الباحث في النهاية إلى أنَّ المسائل الفقهية المبنية على النصوص التي تفيد العموم أكثر من المسائل التي بُنيت على النصوص التي تفيد الخصوص؛ لأن أحكام المكلَّفين كثيرة، ولا فرق بينهم فيها، إلا ما دلَّ الدليل على التخصيص. وفي الختام أوصى الباحث بدراسة المسائل الفقهية المتعلقة بموضوعات لها تعلق بالحديث النبوي الشريف، مثل المسائل الفقهية المبنية على المفاهيم الواردة في الأحاديث النبوية؛ لما في ذلك من الربط بين المسألة الفقهية وبين دليلها من السنة. ودراسة المسائل الفقهية المتعلقة بموضوعات تجمع بين الفقه وأصوله؛ لما في ذلك من الربط بين الفروع الفقهية بأصولها، وبيان مآخذ الأحكام.

Abstract: Title of the thesis: “collection and study of the Doctrinal issues based on texts that differ in their remaining in Generality other than worship”.
Research contents: The research consists of an introduction, a preamble, four chapters, a conclusion, and scientific indexes.
As for the preamble: it contained a brief definition of generality and specification, the types of general, the difference between it and the unrestrained, specification, restriction, abrogation, the rule of working with the general before searching for the specific, the authoritativeness of the general after the specification, the types of specifications, The first chapter dealt with issues of oaths, vows, and hunting and foods, and the second chapter included personal status investigations of marriage, divorce, waiting period, oath, zihar, curse, mourning, and issues of financial transactions, and the third chapter dealt with issues of wills, statutes, felonies of retribution and blood money, and issues of the penalty for adultery, and slander and theft, and the fourth chapter discussed issues of districts and testimonies, then the researcher finally concluded that jurisprudential issues based on texts that benefit the general public more than issues that are built on texts that benefit the individual; Because the provisions of those who are accountable are many, and there is no difference between them, except for what is indicated by the evidence for specification. In conclusion, the researcher recommended studying jurisprudential issues related to topics related to the noble Prophetic hadith, such as jurisprudential issues based on concepts contained in the hadiths of the Prophet; because of the link between the jurisprudential issue and its evidence from the Sunnah, and the study of jurisprudential issues related to topics that combine jurisprudence and its principles; Because of the linkage between the branches of jurisprudence with its origins, and the statement of the points of rulings.
