المستخلص: عنوان البحث: الفروق الفقهية بين المسائل الفرعية في الجهاد – دراسة فقهية مقارنة.
يعد هذا البحث جزءا من مشروع علمي قام فيه الباحث مع مجموعة من الطلاب بجمع الفروق الفقهية في جميع أبواب الفقه.
وقد اشتمل هذ البحث على: مقدمة، وتمهيد، وثلاثة فصول، وخاتمة، وفهارس. وأما المقدمة فقد اشتملت على :الافتتاحية، وأهمية الموضوع العلمية، وأسباب اختيار الموضوع، والدراسات السابقة، وخطة البحث، ومنهج البحث. وأما التمهيد فقد اشتمل على مبحثين الأول : في التعريف بعلم الفروق الفقهية، ويشتمل على أربعة مطالب: تعريفه وأهميته، ونشأته والمؤلفات فيه، والثاني: في التعريف بالجهاد، وبيان أهميته ومنزلته في الشريعة الإسلامية، وبيان أنواعه والحالات التي يصير فيها الجهاد فرض عين ويشتمل على ثلاثة مطالب.
وأما الفصول الثلاثة كانت على النحو التالي:
الفصل الأول: الفروق الفقهية المتعلقة بأحكام جهاد الطلب وجهاد الدفع، وأحكام تصرفات قائد الجيش المسلم وتصرفات المجاهدين وقد اشتمل على مبحثين: المبحث الاول اشتمل على عشرة مطالب، والمبحث الثاني اشتمل على ثمانية عشرة مطلبا.
الفصل الثاني: الفروق الفقهية المتعلقة بأحكام الأسرى والغنائم والفيء وقد اشتمل على خمسة مباحث: المبحث الأول اشتمل على خمسة عشر مطلبا، والمبحث الثاني : اشتمل على تسعة مطالب، والمبحث الثالث: ثلاثة وعشرين مطلبا. والمبحث الرابع الرابع: ستة مطالب، والمبحث الخامس: تسعة مطالب.
الفصل الثالث: الفروق الفقهية المتعلقة بأحكام عقود الأمان التي تعقد بين المسلمين والكفار ويشتمل على أربعة مباحث: المبحث الأول ويشتمل على ستة مطالب، والمبحث الثاني :عشرة مطالب، والمبحث الثالث: تسعة وعشرين مطلبا، والمبحث الرابع أحد عشر مطلبا.
وأما الخاتمة: فقد ذكرت فيها اهم النتائج التي توصلت إليها من خلال دراسة البحث.

Abstract: Research Title: Jurisprudential Differences Between Offshoot Issues in Jihad - A Comparative Jurisprudential Study.
This research is part of a scientific project in which the researcher, with a group of students, collected jurisprudential differences in all chapters of jurisprudence.
This research included: an introduction, a preface, three chapters, a conclusion, and indexes. The introduction included the introduction, the scientific importance of the topic, the reasons for choosing the topic, previous studies, the research plan, and the research methodology. The preface included two topics, the first: defining the science of jurisprudential differences, and it includes four sub-topics: its definition, its importance, its origins, and the written work on it. The second: in defining jihad, explaining its importance and status in Islamic law, and explaining its types and cases in which jihad becomes an individual obligation, and it includes three sub-topics.
The three chapters were as follows:
The first chapter: the jurisprudential differences related to the provisions of the jihad of request and the jihad of defense, and the provisions of the actions of the commander of the Muslim army and the actions of the mujahideen. It included two topics: the first topic included ten sub-topics, and the second topic included eighteen sub-topics.
The second chapter: the jurisprudential differences related to the provisions of the prisoners, spoils, and booty. It included five topics: the first topic included fifteen sub-topics, the second topic it included nine sub-topics, and the third topic included twenty-three sub-topics. The fourth topic included six sub-topics, and the fifth topic included nine sub-topics.
The third chapter: the jurisprudential differences related to the provisions of safety agreements signed between Muslims and non-Muslims, and it includes four topics: the first topic includes six sub-topics, the second topic: ten sub-topics, the third topic: twenty-nine sub-topics, and the fourth topic eleven sub-topics.
The conclusion: I mentioned the most important results that I reached through the research study.
