المستخلص: فهذه رسالة مقدمة لنيل درجة الماجستير من قسم الفقه بكلية الشريعة بالجامعة الإسلامية بعنوان: ((توفيق العناية في شرح وقاية الرواية)) للعلامة زين الدين جنيد بن سندل البغدادي الحنفي (المتوفى في حدود القرن التاسع الهجري) من أول الكتاب إلى نهاية كتاب الزكاة - دراسة وتحقيقا)).
وهو كتاب شرح فيه المؤلف متن الوقاية الذي يعتبر من أهم المتون في المذهب الحنفي، ويتميز الكتاب بأن المؤلف يوضح عبارة المتن بإيجاز، ويورد الأدلة النقلية والعقلية على المسائل، ويكثر التعليلات، ويذكر الاختلاف الوارد في المذهب الحنفي وأقوال المذاهب الأخرى غالبا وأدلتهم، فيناقشها ويرد عليها ولا يشنّع على صاحب القول المخالف.
وتشمل الرسالة على مقدمة وقسمين: أحدهما للدراسة والآخر للنص المحقق.
وأما المقدمة فتشمل: على الافتتاحية، وأهمية الكتاب، وأسباب اختياره، وتحقيق نسبته للمؤلف، والدراسات السابقة، وخطة البحث، والمنهج المتبع في التحقيق.
واشتمل القسم الأول: على فصلين الأول: التعريف بمؤلف المتن ومتنه، والثاني: التعريف بالشارح وشرحه.
وأما القسم الثاني فهو تحقيق النص لكتاب الطهارة وكتاب الصلاة وكتاب الزكاة: وقد حرصت فيه على إخراج النص كما يريده مؤلفه معتمدا في ذلك على ثلاث نسخ خطية، الأولى: نسخة مكتبة الفاتح بإسطنبول، والثانية: نسخة مكتبة الحاجي بشير آغا بإسطنبول، والثالثة: نسخة مكتبة السليمانية بإسطنبول، وقمت بالمقابلة بينها، وضبط النص وفق الرسم الإملائي الحديث، وعزو الآيات، وتخريج الأحاديث والآثار، وشرح الغريب من الألفاظ، وختمت الرسالة بفهارس علمية.
Abstract: This is a thesis submitted to obtain a master's degree from the Department of Fiqh, Faculty of Sharia, Islamic University entitled: ((Tawfiq Al-Einaya fi Sharh Wiqayat Al-rewaya)) of Scholar Zainuddin Junaid bin Sandal Baghdadi Hanafi (deceased within the ninth century AH) from the first book to the end of the book Zakat - a Study and Investigation.
It is a book in which the author explained the texts of (Al-Wiqayah), which is one of the most important text in the Hanafi school, the book is outstanding by the fact that the author explains the text briefly, and provides verbal and logical evidence on the issues with more explanations, and he mentions the difference in the Hanafi school and other opinions and evidence often, and he discusses and responds to them he does not disrespect scholars with contrary view.
The letter includes an introduction and two sections: one for the study and the other for the verified text.
The introduction includes: the preamble, the importance of the book, the reasons for its selection, and investigation of its attribution to the author, and previous studies, research plan, and the approach followed in the investigation.
The first section includes two chapters: the biography of the author of the main text and his work, and the second: the biography of the annotator and his annotation.
The second section is the investigation of the text of the Book of Purity and the Book of Prayer and the Book of Zakat: I was keen to extracting the text as his author wants, based on three written manuscript copies, the first: the copy of the Library of the Al-Fatih in Istanbul, and the second: a copy of the library Haji Bashir Agha in Istanbul, and the third: a copy of the library Sulaymaniyah in Istanbul, and I compared them, and adjust the text according to the modern spelling, and attribute verses, and the extraction of conversations and monuments, and explain the strange words, and I ended the research with scientific indexes..
