المستخلص: هذه رسالة مقدمة لنيل درجة الماجستير من قسم الفقه بكلية الشريعة بالجامعة الإسلامية في المدينة المنورة، وهي عبارة عن دراسة وتحقيق للجزء الثالث من كتاب "توفيق العناية في شرح وقاية الرواية" للشيخ جنيد بن سندل الرومي البغدادي الحنفي، من علماء المائة التاسعة الهجرية، من بداية "باب النفقة" إلى نهاية "باب المرابحة"، وهو شرح مختصر لمتن "الوقاية" للعلامة برهان الشريعة محمود بن أحمد بن عبيد الله بن إبراهيم المحبوبي (ت673هـ)، وهو أحد أهم متون الفقه المعتبرة عند الحنفية.
وقد قسمت الرسالة إلى مقدمة وقسمين: أحدهما للدراسة، والآخر للنص المحقق، أما المقدمة فتشتمل: الافتتاحية، الأهمية العلمية للكتاب المحقَّق، وأسباب اختياره، تحقيق اسم الكتاب، وتوثيق نسبته إلى المؤلف، الدراسات السابقة، الجزء المراد تحقيقه، خطة البحث، ومنهج التحقيق.
أما القسم الأول فقد اشتمل على: فصلَين، الأول: التعريف بصاحب المتن ومتنه، والثاني: التعريف بالشارح وشرحه. وأما القسم الثاني: فهو المختص بالنص المحقق، فقد حرصت فيه على إخراج النص كما أراده مؤلفه، معتمداً في ذلك على ثلاث نسخ خطية، الأولى: نسخة مكتبة الفاتح، بإسطنبول، والثانية: نسخة مكتبة الحاجي بشير أغا، بإسطنبول، والثالثة: نسخة مكتبة السليمانية، بإسطنبول، وكان عملي نسخ النص المحقق من النسخة الأولى والتي عبرتُ عنها بالرمز (أ)، ثم قابلت بينها وبين النسختين (ب) و (ج)، وضبطت النص وفق الرسم الإملائي الحديث، وعزوت الآيات إلى مواضعها من القرآن الكريم وكتبتها بالرسم العثماني، وخرَّجتُ الأحاديث وبيَّنتُ درجتها، وترجمت ترجمة موجزة للأعلام الوارد ذكرهم في الشرح، ووثقت النصوص والآراء والمذاهب الواردة في الكتاب حسب ما وقفت عليه منها، وبيَّنتُ معاني الكلمات الغريبة والمصطلحات العلمية، وميَّزتُ المتن عن الشرح، وأشرت لنهاية كل لوحة من نسخة (أ)، وعلَّقتُ على ما يحتاج إلى تعليق من المسائل العلمية، واستدركت ما يحتاج إلى استدراك، وعرَّفت بالأماكن والبلدان غير المشهورة، وختمت الرسالة بفهارسَ علمية؛ إكمالاً للفائدة وتسهيلاً للقارئ والباحث.
Abstract: This treatise is submitted to obtain a master degree in Jurisprudence from the Faculty of Islamic Law in the Islamic University in Madina. It is a study and an investigation of the third part of the book entitled “Good guidance in the explanation of the protection of narration” by Sheikh Junaid Sandal Al Romi Al Baghdadi Al Hanafi. He was one of the scholars of the ninth Hijri century. The book is from the start of “Spending” chapter to the end of “Trading” chapter. It is an abridged explanation of “Protection” text by the scholar Mahmud Ahmad Obaidullah Ibrahim Al Mahbobi (date of birth: 673 A.H). He is one of the greatest jurisprudence scholars, greatly respected by Hanafia.
The treatise was divided into two parts and a preamble. One chapter is for the study itself and the other for the checked text. The preamble includes: an introduction, the scientific importance of the checked book, reasons to choose it, checking of the name of the book, making sure it belongs to the author, previous studies, the part required to be checked, research plan and the methodology of check.
The first part includes two chapters: defining the writer of the text and the text itself. The second chapter defines the explanation and who makes it. The second part focuses on the checked text. I was keen to show the text as its author intended to show it. I depended on three written copies. The first one: the copy of Al Fateh library in Istanbul. The second one: copy of Al Haji Bashir Agha library in Istanbul. The third is a copy of Al Sulimania library in Istanbul. I worked to copy the checked text from the first copy which I referred to it by the symbol “A” then I compared it to the two copies “B” and “c”. I corrected to the text to be according to the modern orthography. I showed the position or numbers of the Holy Quran verses and wrote them in Othmani orthography. I checked the Hadiths and showed the degree of their correctness. I made short profiles for the great figures mentioned in the explanation. I checked texts, opinions and creeds in the book to be correct. I showed the meanings of strange words and scientific terms. I showed the difference between the text and its explanation. I showed the end of every unit in the copy “A”. I also inserted my comments on some scientific issues and explained what needed to be explained. I defined all nit famous countries and towns; I concluded the treatise with a scientific index to make the benefit greater and make it easy for readers and researchers.
