تم جمع مسائل هذا البحث واستخراجها من الكتب المعتمدة عند متأخري الحنابلة، وهي المسائل المنصوصة عليها بأدوات الاستثناء: (إلا أو إحدى أخواتها)، أو ما ورد الاستثناء فيه بلفظ: (الاستثناء، وما تصرف منه)، أو ما يفهم منه الاستثناء ويستنبط من خلال أقوال الفقهاء، وتمت دراسة تلك المسائل ببيان حكم الأصل ودليله، وذكر من وافق عليه من بقية المذاهب، ثم الإشارة إلى ما ورد من الاستثناءات فيه، ودراسة تلك المستثنيات ببيان حكمها ودليلها، وذكر الوفاق أو الخلاف الوارد فيها داخل المذهب الحنبلي.
حدود البحث: اشتمل البحث على مقدمة، وتمهيد، وسبعة فصول، الفصل الأول: في باب أحكام المياه، والثاني: في باب الآنية، والثالث: في باب الاستطابة وآداب التخلي، والرابع: في باب السواك، والخامس: في باب الوضوء، والسادس: في باب المسح على الخفين، والسابع: في باب نواقض الوضوء.
أهم النتائج التي توصلت إليها: بيان أهمية العناية بالاستثناءات الفقهية؛ لما فيها من ربط الفروع بالأصول، وإدراك أسرار الشريعة وحكمها، وضبط المسائل المتفرقة وضمها تحت سلك واحد، مما يعين على التصور الدقيق والفهم التام لها.
Abstract: Thesis Title: Jurisprudential Exceptions in Ibada (act of worship) according to the Hanabila School of thought from the beginning of Book of Purity to the last Chapter of Ablution Nullifiers, "Compilation and Studying", this is an academic thesis submitted to obtain a global doctorate, from the Department of Jurisprudence in the Faculty of Shariah in the Islamic University of Madinah.
This research cases were compiled and extracted from approved books by the late Hanabila school of thought, those cases are the stipulated cases with exceptive elements namely: (Illaa, ihdaa and the likes), or wherein exception is mentioned in wording namely: (Istithnaa'u and its related issues) or sayings of the jurists which indicate exception, study was made over those cases and their base ruling with evidence was explained, those who agreed with the ruling among the remaining schools of thought were mentioned, then some exclusions in the ruling were referred to, and those exclusions were also studied and their ruling and evidence was explained, and any agreement or disagreement that exist within the Hanabila school of thought was also mentioned .
Research limits: The research entails an introduction, a preface, and seven chapters, first chapter: section of rulings on water, second chapter: section of utensils, third chapter: section of body cleanness and toilet etiquette, fourth chapter: section of chewstick (siwaak), fifth chapter: section of ablution, and sixth chapter: section on wiping over the socks, and seventh chapter: section on the nullifiers of ablution.
Important Research Result: this research explains the importance of being concerned about the jurisprudential exception; because it enhances linking of branches to fundamentals, having in-depth comprehension of Shariah and its rulings, fixing and grouping of scattered cases under one fold, which helps in having an accurate perception and a complete understanding of them.
