الباب الأول: وفيه عشرةُ فصولٍ: تدور حول الطَّهارة، والنَّجاسات، والحيض، والمواقيت، والأذان، وصلاة الجماعة، والإمامة، والجمع بين الصَّلاتين، والقصر في السَّفر، وصلاة الجمعة، وصلاة الخوف، وصلاة الاستسقاء، وصلاة الجنائز، والمساجد ومواضع الصَّلاة.
والباب الثاني: وفيه خمسة فصول: وهي، الزَّكاةُ، والصَّومُ، والحجُّ، والأضحيَّةُ، والعقيقةُ، والذَّبائحُ، والجهادُ.
وقد وصلتُ إلى مجموعةٍ من النتائج، ومِن أبرزها ما يلي:
1) إنَّ مباحث العموم والخصوص مِن أهمِّ المباحث الَّتي تداولها الفقهاء والأصولييِّن، واعْتَنُوا بها في كُتُبهم، واستخرجوا منها لطائف المعاني، وقواعد المباني.
2) إنَّ قول بعضهم: «ما مِن عامٍّ إلَّا وقد خصِّص» كلامٌ غيرُ صحيحٍ.
3) وقد بلغ عدد المسائل الفقهية الَّتي تناولتُها في البحث، حسب جمعي، مائة وخمسين(150) مسألة فقهيَّةً.
وقد ظهر لي من خلال هذه الدِّراسة أنَّ المسائل الفقهيَّة المبنيَّة على النُّصوص الَّتي تفيد العموم أكثر من المسائل الَّتي بُنيت على النُّصوص الَّتي تفيد الخصوص؛ وذلك لأنَّ أحكام المكلَّفين كثيرةٌ جدًّا، وهُم فيها على السَّوَاء، إلَّا ما دلَّ الدَّليل على التَّخصيص، وهو قليلٌ.
Abstract: Abstract
Title: Collection and study of Fiqh Issues related to Ibadat (acts of worship) that are based on texts about which there is controversy as to whether it's utterance remain general (unspecific) or not.
The research is made up of introduction, preface, two main chapters, conclusion and bibliography.
Chapter one: It contains ten sub chapters, which revolve around purification, impurities, menstruation, prayer's time, call to prayer, Salaat, congregational prayer, leading prayer, combining two salaat, shortening of Salaat when traveling , juma'at prayer, the fear prayer, the rain-invoking prayer, funeral prayer, mosques and prayer places.
Chapter two: It contains five sub chapters which revolve around Zakat, Fasting, Pilgrimage, udhhiya (an animal sacrifice during eid adhha), aqiqah (birth sacrifice), sacrifice generally and Jihad.
Findings:
1) The fields of general and specific utterances are among the important fields researched extensively from different angles by experts in fiqh and Usool.
2) The notion that " there is no general utterance that has not been particularized" is not correct.
3) The number of fiqh issues dealt with in this research is(150 ) issues.
The number of fiqh issues that are based on general utterance are more than those based on specific utterance, that is because rulings affecting worshippers are too numerous, in which they are all equal. For it to be specific, there is a need for a proof, which is rare.
