المستخلص: الحمد لله، والصلاة والسلام على رسولنا الأمين وعلى آله وصحبه أجمعين، وبعد: فهذه رسالة مقدمة لنيل درجة الماجستير من قسم أصول الفقه بكلية الشريعة بالجامعة الإسلامية بالمدينة المنورة، وعنوانها: الاختيارات الأصولية في مباحث الحكم والأدلة للإمام أبي القاسم عبدالكريم بن محمد الرافعي الشافعي المتوفي سنة 623هـ, جمعا ودراسة. وقد أخذ زميلي أُكَابا إلْيَان القسم الباقي من المشروع. وتحتوي هذه الرسالة على مقدمة وتمهيد وبابين وخاتمة وفهارس علمية. أما المقدمة فتشتمل على أهمية الكتابة في الموضوع وأسباب اختيار الموضوع وخطة البحث والدراسات السابقة ومنهج البحث والشكر والتقدير. واشتمل التمهيد على ثلاثة فصول؛ الأول: في حياة الإمام الرافعي الشخصية, والثاني: في حياة الإمام الرافعي العلمية والعملية, والثالث: في اختيارات الرافعي الأصولية. أما البابان فقد كان الباب الأول: في اختيارات الرافعي المتعلقة بمباحث الحكم وذلك في ثلاثة فصول؛ الأول: في اختيارات الرافعي المتعلقة بالحكم التكليفي وذلك في أربعة مباحث, والثاني: في اختيارات الرافعي المتعلقة بالحكم الوضعي وذلك في تمهيد وخمسة مباحث, والثالث: في اختيارات الرافعي المتعلقة بأركان الحكم. وكان الباب الثاني: في اختياراته المتعلقة بالأدلة الشرعية وذلك في فصلين؛ الأول: في اختيارات الرافعي المتعلقة بالأدلة المتفق عليها وذلك في أربعة مباحث, والثاني: في اختيارات الرافعي المتعلقة بمباحث الأدلة المختلف فيها والاستدلال في ستة مباحث. أما الخاتمة فقد اشتملت على أهم النتائج المستخلصة من الرسالة والتوصيات، ثم الفهارس. يتلخص منهجي في البحث على جمع المادة العلمية ثم دراسة اختيارات الرافعي الأصولية, وتوثيق النصوص من مصادرها الأصلية، وكتابة الآيات القرآنية بالرسم العثماني, وتخريج الأحاديث, وتوثيق الآثار, وشرح المصطلحات العلمية والكلمات الغريبة, والتعريف بالفرق والمذاهب, كل ذلك من المصادر العلمية، والالتزام بعلامات الترقيم وضبط ما يحتاج إلى ضبط، وتذييل الرسالة بالفهارس حسب الخطة. وصلى الله وسلم على نبينا محمد، وعلى آله وصحبه أجمعين.

Abstract: Praise be to Allah, and may peace and blessings of Allah be upon our Prophet Muhammad the most trust worthy and his family and companions, after that: This is a thesis submitted to obtain a Masters degree from the Department of the Fundamentals of Fiqh, in the Faculty of Sharia at the Islamic University of Madinah. Titled: The choices of Jurisprudence Fundamentals in the Sections of Law and Evidence of Imam Abu al-Qasim Abdul Karim bin Muhammad al-Rafi’i al-Shafi’i, who died in 623 AH, collected and studied. The rest of the project was done by my colleague Ukaba Elian. The thesis includes an introduction, a preface, two divisions, a conclusion, and scientific indexes. The introduction comprises of the importance of writing on this topic, the reasons for choosing it, previous studies, the research plan, the research method and thanks and appreciation. The preface included three chapters; First: The personal life of Imam Al-Rafi'i. Second: Imam Al-Rafi'i's educational and practical life Third: Al-Rafi’i's Jurisprudence fundamentals choices. As for the Two Divisions: The first was: On the choices of Al-Rafi’i related to the Sections of Law, in three chapters; The first: On Al-Rafi’i’s choices related to the legal obligation of law in four sections, the second: On Al-Rafi’i’s choices related to postural law in a preface and five sections, the third: On Al-Rafi’i’s choices related to the pillars of law. The second chapter: On his choices related to the Sharia's evidence in two chapters; The first: On Al-Rafi’i’s choices related to the agreed upon evidence in four sections, and the second: On Al-Rafi’i’s choices related to the sections of disagreed evidence and inference in six sections. As for the conclusion, it included the most important results extracted from the thesis and recommendations, then indexes. My approach in this research is summarized as follows: gathering information related to the topic, then studying the objections, documenting texts from their original sources, writing the Qur’anic verses in Othmani format, Hadith Verification, and Acceptance, documenting statements of the prophet's companions, explaining educational terms and strange words, defining Sects and schools of thought, all of that from their sources, and adhering to punctuation marks and giving harakaat where Needed, and append the research with indexes according to the plan. May Allah's peace and blessings be upon our Prophet Muhammad, and upon all his family and companions.
