المستخلص: وقد اكتسب هذا الكتاب أهميّة العلميّة من عدّة جوانب, منها: أنَّ منزلته تأتي من أهميّة العلم الّذي يحويه, فهو يتحدّث عن المسائل الفقهيّة, والسّياسة الشّرعيّة, ويزخر بالأدلّة من الكتاب والسّنة النّبويّة, فيستفيد منه الفقهاء, والمحدّثون, وطلاّب العلم, ومن هم على صلةٍ وثيقةٍ في مجال السّياسة, ولهم اهتمام وعناية فيها, كما أنَّ أهميّته تظهر أيضاً من خلال ما اشتمل عليه من آراءٍ وتحقيقات علميّة مفيدة.
وقد اشتمل البحث على التالي:
1- مقدمةٌ، وتشتمل على: الافتتاحية, والأهمية العلميّة للكتاب المحقّق وأسباب اختيار الكتاب المحقّق, وتوثيق نسبته إلى مؤلّفه, والدّراسات السّابقة تقسيم المشروع (خطة البحث), منهج التّحقيق, وصف النّسخ الخطيّة, ملاحق الخطة (نماذج من النّسخ الخطّية).
2- قسمي الدّراسة والتي تشتمل على دراسة المؤلف من خلال بيان نبذة تأريخية عن عصر المؤلّف, وحال النَّظام القضائيّ في عصره, وأثر ذلك في مؤلَّفه, وذكر إسمه, ونسبه, وكنيته, ومولده, ونشأته, ووفاته, وشيوخه, وتلاميذه, وبيان عقيدته, ومذهبه الفقهيّ, وذكر مؤلّفاته, وبيان مكانته العلميّة, وثناء العلماء عليه.
وأمَّا دراسة الكتاب فتشتمل على تحقيق عنوان الكتاب, وتوثيق نسبته إلى مؤلّفه, وبيان موضوع الكتاب, ومنهج مؤلّفه, ومصادر مؤلّفه (موارده في كتابه) ومقدار إفادته منها, وبيان مكانة الكتاب العلميّة بين كتب القضاء والسّياسة, ومقارنته بغيره من كتب المذهب المقاربة له في الموضوع, أو المعاصرة له.
3- وأخيراً النّص المحقّق, ثم ختمت البحث بالفهارس العلميّة التي تعيّن على الاستفادة من البحث.
وهذا البحث فيه مساهمة في نشر بعض مسائل السّياسة الشّرعيّة, وتسهيل الوصول إليها بشكل واضح وميسَّر.
هذا وأسأل الله -عزّ وجلّ- أن يجعله خالصاً لوجهه الكريم, وأن يعفو عن الخلل والزّلل, وأن ينفع به الباحث والقارئ, والحمد لله ربّ العالمين.
Abstract: This book has acquired its scientific importance in several aspect, including: that it's status is derived from the importance of the knowledge, which it contains; because it addresses the issues of Islamic Jurisprudence and Islamic legal politics, and it abounds in the evidences of the Qur'an and Sunnah of Prophet Muhammad (May the peace and blessings of Allah be upon him). Hence, it is advantageous to jurist, scholars of hadith, students of knowledge, and those closely related to the field of politics, and who have interest in it. Besides, its importance is also shown through the valuable views and scient conclusions it contains.
The research included the following:
1. Introduction, which includes: the preface, the academic significance of the edited book, the reasons for selecting it, authentication of its ascription to its author, literature review, division of the research project (Research plan), methodology of edition, description of the handwritten manuscripts and appendages to the research plan (samples of the handwritten manuscripts).
2. Study section, which includes the study of the author through a brief history of his era, and the condition of the judicial system in his time, and the impact of this in his book, declarations of his name, lineage, nickname, birth, upbringing, death, his teacher, disciples, belief, his jurisprudential doctrine, and statements of his writings, his scientific status, and the commendation accorded him by other learned scholars.
The study of the book includes the validation of its title, authentication of its attribution to the author, statement of the theme of the book, the author's methodology in it, reference of the author (his resources in his book) and the amount of adaptation from them, indication of the scientific status of the book among the books of Jurisprudential doctrine or contemporary writings on the same subject.
3. Finally, the investigated text. Following this, I concluded the research whit scientific indexes that help to benefit from it.
This research contributes to the dissemination of some issues of Islamic shariah politics and facilitates access to them in a clear and accessible manner.
