المستخلص: تدور موضوعات هذه الدراسة، حول آليات وضوابط إبرام وتنفيذ العقود الإدارية، في نظام المنافسات والمشتريات الحكومية السعودي؛ حيث تكتسب هذه الدراسة أهميتها من أهمية العقود الإدارية التي يتم إبرامها من خلال نظام المنافسات والمشتريات الحكومية السعودي، ودور هذه العقود كبير في النشاط الإداري للحكومة؛ حيث أن أغلب المشاريع التنموية التي تقوم الدولة بتبنيها، تتم من خلال العقود الإدارية، كما أن هذه الدراسة تجمع بين الجانب النظامي والجانب الشرعي بقدر الإمكان، وقد تم تقسيمها إلى، تمهيد، وخمسة فصول، وخاتمة، وفهارس عامة، على النحو التالي:
1- التمهيد وشتمل على التعريف بألفاظ العنوان.
2- الفصل الأول، وشتمل على الآليات والضوابط التي تسبق إبرام العقود الإدارية.
3- الفصل الثاني، وشتمل على آليات إبرام العقود الإدارية.
4- الفصل الثالث، وشتمل على ضوابط إبرام العقود الإدارية.
5- الفصل الرابع، وشتمل على آليات وضوابط تنفيذ العقود الإدارية.
6- الفصل الخامس، وشتمل على الرقابة الادارية والقضائية على أعمال إبرام وتنفيذ العقود الإدارية.
وقد تبين للباحث من خلال هذه الرسالة، أن العقد الإداري، وإن كان من العقود المستحدثة، إلا أنهّ داخل في عموم النصوص الشرعية الدالة على الوفاء بالعقود، كما أن مصطلح المناقصة الحكومية في صورته الحديثة هو مصطلح قانوني حديث، لم يرد له ذكر في مدونات الفقه الاسلامي، وهي من الإجراءات والاليات المعاصرة التي تتعامل بها الجهات الحكومية لتأمين احتياجاتها وتنفيذ مشروعاتها، ومع ذلك فإن نصوص الكتاب والسنة النبوية، تستوعب جميع العقود المستحدث وتبين حكمها الشرعي؛ كون الشريعة الإسلامية صالحة لكل زمان ومكان.
Abstract: This study discusses the mechanisms and settings of executing and putting administrative contracts in force in the system of Saudi governmental purchase competition. This study has a great importance such as the importance of the administrative contracts executed during that system. The role of these contracts is great in the governmental and administrative activity. Most of the development projects which the kingdom adopt are done through the administrative contracts. This study combines both the systematic and legal aspects as much as possible. The study was divided into a preamble, five chapters, conclusion and general indexes as follows:
Preamble which includes the definition of the title words.
First chapter: it includes the mechanisms and settings which precede the executing of legal contracts.
Second chapter: it includes the mechanism of executing the administrative contracts.
Third chapter: it includes the settings of executing the administrative contracts.
Chapter four: it includes the mechanisms and settings of executing the administrative contracts.
Chapter five: it includes the administrative and judiciary monitoring of the acts of executing and putting administrative contracts in force.
Through this treatise, the researcher found that the administrative contract, though they are innovated, they are included in the general religious texts which show the necessity to fulfill contracts. The term of the government bidding in its modern form is a modern legal term which was never mentioned in the Islamic history blogs. It is one of the
modern mechanisms and procedures which the governmental bodies work with to ensure their needs and carry out their projects. In spite of that, the texts from the Holy Quran and Sunnah includes all modern contracts and show their legal ruling. The Islamic Sharia is valid for all places and times.
