Abstract: This study is part of an academic project entitled: Rulings of Jurisprudence Issues based on its Principles in the book of "Al-Tahbeer Shar'h al-Tahreer", by Al-Mardawi. It consists of four theses. This study is on the section; "Linguistic Principles and Shari'ah Governance", it is the first part of these four theses.
The Research Methodology: The Descriptive Approach.
The study consists of an introduction, a preface and two parts. The first part is on the Rulings of Jurisprudence Issues based on its Principles on the issues relating to linguistic fundamentals. It includes two chapters. The second part: On the Rulings of Jurisprudence Issues based on its Principles in the Shari'ah rulings. It includes ten chapters, and conclusion.
Most Significant Results of the Study:
1. The Science of the Rulings of Jurisprudence Issues based on its Principles is one of the most important knowledge, linking the Principles of Jurisprudence with its benefits.
2. Al-Mardawi is the Sheikh and Imam of the Hanbali Doctrine, its Corrector and Editor.
3. The book (Al-Tahbeer Shar'h al-Tahreer) is Encyclopedia of Principles of Jurisprudence, as al-Mardawi was keen on compiling the issues of the Principles of Jurisprudence and was keen to mention the four Schools of Thoughts, renowned scholars, and he gave importance to explaining the Hanbali Doctrine in the Principles of Islamic Jurisprudence, and in compiling the scattered issues from its original sources, and in mentioning the Jurisprudence Issues in his book as an example most of the time.
4. Indeed the Scholar of Principles of Jurisprudence were interested in the Meanings of the prepositions and particles and some disagreement in the Jurisprudence Issues were based on it.
5. The Shari'ah ruling is the results of the Principles of Jurisprudence, which are five: Obligatory, Recommended, Forbidden, Disapproved, Permissible. And the Cause, Preventor, Condition, Validation, Corruption, Permission, determination are from the conventional provisions.
