"ينبغي" بين الاستعمال اللغوي والشرعي

Title “Yan ba ghi” between the Linguistic and Islamic Legal Usage”

المستخلص: الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبه أجمعين، أما بعد: يهدف هذا البحث المعنون له بــــ"ينبغي" بين الاستعمال اللغوي والشرعي" إلى بيان أصل معنى الفعل (ينبغي)، وتتبع استعماله في كلام العرب، وأوجه الاستعمال الواردة فيه مع بيان الصحيح والخاطئ منها، وذكر ما لحق به من معان أخرى حسب دلالات السياق المختلفة من خلال كتب اللغة العربية والمعاجم والتفسير والحديث، وبيان دلالته عند علماء الشريعة مع الموازنة بينها وبين دلالته عند اللغويين، متبعاً في ذلك المنهج الوصفي والتحليلي بخطواته العلمية المتعارف عليها، وقد جاء البحث في مقدمة وخمسة مباحث وخاتمة وثبت بالمصادر والمراجع وفهرس الموضوعات. ومن أهم النتائج التي تمخضت عن البحث: أن اللغويين قد ذكروا أربعة معانٍ فقط لهذا الفعل، وهي: الطلب، وجنس من الفساد، والنظر إلى الشيء كيف هو، وانتظار الشيء ومراقبته، والتي يرى بعضهم أنها مستنبطة من المعنى الأول عن طريق التوسع والكناية، بينما توسع فيه علماء الشريعة الإسلامية حيث ذكروا له عدة معانٍ مستنبطة من سياق النصوص والأدلة الشرعية، ومنها: يكون، ويصح، ويصلح، ويليق، ويسهل، ويتسهل، ويتسخر، ويتأتى، ويمكن، ويستقيم، ويخوّل ويجوز، و(لا ينبغي) على العكس من تلك المعاني. ومن النتائج أن الأصل في مدلول الفعل "ينبغي" هو مجرد طلب الفعل، والطلب قد يكون جازما وقد يكون غير جازم حسب القرائن ودلالة السياق، وأيضاً لم يبحث الأصوليون دلالة هذا الفعل في مباحث الألفاظ، على الرغم من أنه قد ورد مستعملا في القديم والحديث على عشرة أوجه، منها وجهان في القرآن الكريم، وكلها صحيحة إلا الوجه الذي يتعدى فيه بـ(على) وقد أثبت البحث أنه من لحن العامة، والله أعلم، وصلى الله وسلم على نبينا محمد، وعلى آله وصحبه أجمعين. الكلمات المفتاحية: ينبغي، لا ينبغي، الاستعمال الشرعي، الاستعمال اللغوي، صيغ الأمر، صيغ النهي.
Abstract: All praise is due and belongs to Allah. May the peace and blessings of Allah be upon the Messenger of Allah and his family and companions. The purpose of this research entitled “Yan ba ghi” between the Linguistic and Islamic Legal Usage” is to indicate the original meaning of the Arabic present simple verb "Yan ba ghi" translated as (Should) in English, and trace its usage in Arabic language, the various forms it was used during the ancient and modern periods, stating the correct and wrong usages, as well as the subsequent meanings it derived from various contexts through Arabic language books, dictionaries, books of Qur'anic Exegesis (Tafseer) and traditions of Prophet Muhammad (Hadith). It further aims to explain its meaning according to the scholars of Shari’ah in a contrast with the view of the scholars of Arabic, adopting the descriptive and analytical methodology according to its customary academic steps. The research appeared in an introduction, a preface, five research sections, the conclusion, the bibliography and table of contents. The paramount findings of the research include that scholars of Arabic have stated four major meanings and implications for this verb “Yan ba ghi”, which some scholars deem to have been derived from the initial meaning of demand and response to demand, through metonymy and expansion in the use of figurative language. Scholars of Shari’ah stated much more meanings derived from the contexts of legal texts and evidence including “is, is valid, suits, befits, becomes easy, becomes facilitated, abounds, becomes feasible, can, becomes right, empowers, becomes authorized and permissible as required by the context, while the phrase (La Yan ba ghi) indicates exactly the opposite meanings of these words. One of the major findings is that the original meaning of the verb "Yan ba ghi" is to request someone to do something, and the request may be firm and may be irresolute depending on the evidence and contextual clues. Scholars of the Principles of Islamic Jurisprudence have not discussed the meaning and implication of this verb in their works despite the fact that it has been used in the past and present in ten different forms and aspects, including two aspects in the Holy Qur’an, all of which are valid except the aspect where it is rendered transitive by the Arabic preposition “Ala” as a copular. However, the research has proved that it is a common mistake, and Allaah knows best. May the peace and blessings of Allaah be upon our Prophet Muhammad, and his family and companions.
