المستخلص: تهدف هذه الدراسة لبيان الأحكام الشرعية والقانونية للنيابة الاتفاقية للأشخاص الاعتبارية، وقد استخدمت في بحثي المنهج التحليلي التأصيلي المقارن، حيث يُبين القواعد العامة التي تحكم الموضوع وفروعه المختلفة، ومن أهم نتائج البحث أن النيابة في التصرفات القانونية قد جاءت على خلاف الأصل، وأن الشخص الاعتباري ليس له عقل يميز به، وله حقوق قبل غيره، وعليه واجبات مالية يطلبها أربابها، والشخص الاعتباري لا يستطيع بنفسه أن يقوم بهذه الحقوق والواجبات بحكم طبيعته، وبالتالي لابد له من نائب شأنه في ذلك شأن الصبي غير المميز ومن في حكمه ، وأن الشريعة الإسلامية قد سبقت كل القوانين الوضعية التي قررت فكرة الشخص الاعتباري، وهذا يدل على عموم الشريعة الإسلامية وقدرتها على تنظيم جميع الأمور التي تستجد في حياة الناس إلى أن يرث الله الأرض ومن عليها .

Abstract: This study aims to explain the legal and legal provisions of the Public Prosecution for the legal persons, and I have used in my research the analytical and comparative approach, as it shows the general rules governing the subject and its various branches, and one of the most important results of the research is that the Public Prosecution in legal actions came against the original, and that the legal person is not He has a mind that distinguishes him, and he has rights before others, and he has financial duties that his employers demand, and the legal person himself cannot perform these rights and duties by virtue of his nature, and therefore he must have a deputy like that in the case of the unmarked boy and his rule, and that Islamic law has All the positive laws preceded the decision of the legal person, and this indicates the general Islamic law and its ability to organize all matters that occur in people's lives until God inherits the earth and those on it
