المستخلص: ركز هذا البحث والمعنون بــ" علاقة القاضي بالمجتمع خارج مجلس القضاء " دراسة فقهية مقارنة " على بيان الحكم الشرعي في العلاقات القائمة بين القاضي و المجتمع ، فالحاجة ماسة لبيان الحكم الشرعي لتلك العلاقــة، وبيان قواعد ما يحل ويحرم منها ؛ رفعا للحرج والعنت الذي يلحق بالقضاة و المجتمع في تلك المسائل ، و قد تم حصر أوجه العلاقة التي ذكرها الفقهاء في تسعة أوجه إجمالا هي : بيع القاضي و شرائه ، و اقتراض القاضي و استعارته الحوائج من الناس ، و قبول القاضي للهدية ، و زيارة القاضي للناس ، و حضور القاضي الجنائز ، وسلام القاضي على من مر عليه ورده على من سلم عليه ، و اشتغال القاضي بالتعليم والفتيا ، و ضيافة القاضي واستضافته، و دفع الصدقة والزكاة والهبة للقاضي . وقد تطرق البحث إلى بيان موقف العلماء من تلك الأوجه وبيان الراجح بدليله من خلال المنهج الاستقرائي التحليلي.
والباحث يوصي في بحثه بضرورة وضع لائحة من قبل الجهات المختصة توضح قواعد سلوك القاضي في مجتمعه من خلال الرجوع إلى أحكام هذه الشريعة الغراء.
Abstract: This research focused on "the judge's relationship with the community outside the Judicial Council Comparative Fiqh Study on the statement of legitimacy in the relations between the judge and the community, there is urgent need to indicate the legitimacy of that relationship, To increase the embarrassment and indignity of judges and society in those matters. The relationship was restricted in nine aspects: selling and buying the judge, borrowing the judge and borrowing the needs of the people, accepting the judge for the gift, visiting the judge for the people, attending the funerals judge, and the judge's safety over those who passed it on to And the judge's work and education, and hosting the judge and hosting, and pay charity, Zakat and gift to the judge. The research dealt with the statement of the position of the scientists from these aspects and the most likely evidence of his evidence through the analytical inductive method
The researcher recommends in his research the need to establish a list by the competent authorities to clarify the rules of conduct of the judge in his community through recourse to the provisions of this law Glue.
