المستخلص: صدر النظام البحري التجاري السعودي متضمناً التأمين البحري، ليعكس بذلك تطوراً تنظيمياً ملحوظاً في المجال التشريعي في المملكة العربية السعودية، فالتأمين البحري يعتبر ضمانة الاستقرار للعمليات التجارية البحرية على الصعيد الوطني والإقليمي والدولي. ولمواكبة هذا التطور رأينا أنه من الضروري تخصيص هذا البحث العلمي حول دعوى الخسارة البحرية وآثارها كوسيلة من وسائل حصول المؤمن له على التعويض. وتمثلت مشكلة البحث في عدة تساؤلات، اتبعنا في حلها المنهج التحليلي الاستقرائي. وأسفرت عن نتائج وإشكالات نظامية، ومن أهمها أن المنظم السعودي لا يعتد بالحطام عند تقدير التعويض في الخسارة المشتركة مع أنه أقر بقيمته المالية. وقدمنا كذلك التوصيات اللازمة لمعالجة تلك الإشكالات، ويأتي في مقدمتها حث المنظم على إدراج قيمة الحطام البحري ضمن الخسائر المشتركة، آملاً أن يقوم أصحاب الاختصاص بأخذها بعين الاعتبار.

Abstract: The Saudi maritime law has been issued including marine insurance to reflect the notable development of Saudi legislation. Marine insurance can be seen as security of stability for marine transactions at the national, regional, and international levels. Therefore, to keep pace with such developments, there is a necessity to launch this study focusing on the lawsuit of marine loss as a method that enables the insuree to gain their compensations. The study has put forward several questions as a research problem, and to reach their answers we pursue an analytical and inductive methodology. The research questions have led to legal results and difficulties. The most significant result is that Saudi legislator does not include ship debris in general averages, although he evaluates them financially. The study has provided several recommendations to be taken into consideration by the competent authority. In front of them is that the legislator may include the ship debris value in general averages.
