المستخلص: تهدف الدراسة إلى استخلاص المسائل الأصولية عند الإمام الزنجاني وترتيبها على طريقة جمهور الأصولين، ثم مراجعة كتب الحنفية الأساسية، والمتون المرعية؛ للتوثيق والتوسع في العرض والإحالة. ويتبع هذا البحث المنهج التوثيقي الدراسي؛ إذ نقلت ووثقت ما اعتمد في هذا المذهب عند الحنفية من عبارات وكلام الأصوليين المتقدمين والمتأخرين. ويشتمل البحث على مقدمة وتمهيد، وثمانية مباحث، وخاتمة. المبحث الأول: باب الأحكام الشرعية، وفيه عشرة مسائل، والمبحث الثاني: باب الأدلة الشرعية المتفق عليها: "دليل السنة"، وفيه ثلاثة مسائل، والمبحث الثالث: باب النسخ، وفيه مسألة واحدة ، وهي: هل الزيادة على النص نسخ؟ والمبحث الرابع: باب دليل القياس، وفيه ثمانية مسائل، والمبحث الخامس: باب الأدلة المختلف فيها، وفيه ستة مسائل، والمبحث السادس: باب دلالات الألفاظ، وفيه إحدى وعشرون مسألة، والمبحث السابع: باب في أدوات المعاني، وفيه ثلاثة مسائل، والمبحث الثامن: باب الاجتهاد والترجيح، وفيه ثلاثة مسائل. ومن أبرز نتائج البحث: 1- أن نقولات الإمام الزنجاني عن مذهب الحنفية، والنسبة إليهم في مجملها صائبة ودقيقة إلا في مسائل نبهت عليها في مواضعها. 2- أن بعضاً من المسائل التي فرعها على بعض الأصول: لا تتوافق مع تخريج الحنفية لها في كتبهم، وقد نبهت عليها في موطنها. ثم أوصى الباحث نفسه والباحثين بالسير على منهج الإمام الزنجاني رحمه الله في هذا الكتاب، وهو منهج علمي دقيق الذي تمثل في إبراز دور مدرستين كبيرتين أصيلتين، وهما: الحنفية والشافعية ، وتأصيل الخلاف بينهما، وإبراز الفروق فيها، مع ترتيب الثمرات والتفريعات وتطبيقه على المسائل المعاصرة.

Abstract: The study aims to extract the issues of fundamentals of jurisprudence by Imam Al-Zanjani, and arrange them according to the method of the majority of the scholars of fundamentals of jurisprudence, then review the basic Hanafi books, and the observed texts, for documentation and expansion in the presentation and referral. This research follows the academic documentation method, as it quoted and documented the quotes of the early and late fundamentalists in the Hanafi thought school. The first chapter: on legal rulings, which includes ten issues, the second chapter: the agreed-upon legal evidence: “Evidence from the Sunnah,” which contains three issues, the third chapter: on abrogation, and it has one issue, which is: Is the addition to the text abrogation? The fourth chapter: on analogical evidence, which includes eight issues, the fifth chapter: the evidence with different opinions, which contains six issues, and the sixth chapter: semantics chapter, which contains twenty-one issues, and the seventh chapter: on tools for meanings, in which there are three issues, and the eighth chapter: Ijtihad and validation, and it has three issues. The most important results include: 1- The qoutes of Imam al-Zanjani from the Hanafi school, and the attribution to them are true and accurate, except in issues that I have pointed out in their places. 2- Some of the issues are branched into some of the fundamentals that disagree with the Hanafis’ books, and it was pointed out in their places. The researcher recommended for himself and other researchers to follow the approach of Imam Al-Zanjani, may God have mercy on him, in this book, which is a precise scientific approach that was represented in highlighting the role of two great and authentic schools, namely: the Hanafis and Shafi’is, and extrapolating the dispute between them, and highlighting the differences in them, with the presentation of the benefits and branches and its application to contemporary issues.
