المستخلص: إن ّالناظر في كتب الأصول والفقه عند الحنفية رحمهم الله تعالى يجد فيها بعض المصطلحات التي تحتاج إلى تأمّل كبير، وتدقيق واسع؛ للوصول إلى غورها، ومعانيها، ومن خلال النظر في مصطلحاتهم نجد مصطلحا قد أشكل في ظاهره على الباحثين، ألا وهو: مصطلح: "السنة المؤكدة"، وقد أردت التتبع لهذا المصطلح بالكلام على حقيقته، وأحكامه، وثمراته عند الأصوليين والفقهاء من الحنفية رحمهم الله، وسميت البحث: "السنة المؤكدة عند الحنفية، حقيقتها، وآثارها". ويتبع هذا البحث المنهج الاستقرائي التطبيقي؛ إذ فيه استقراء تعريفاتهم لهذا المصطلح، وأبرز أحكامهم، مع التطبيق لها، وبيان فوائدها، وثمراتها. ويتكون البحث من تمهيد ، وثلاثة مباحث، وخاتمة. وتناولت في التمهيد: وتعريف السنة لغة واصطلاحاً، ثم تقسيمات السنة إجمالا عند الحنفية، والفرق بينها، والأحكام المترتبة عليها. المبحث الأول: تعريفات فقهاء الحنفية وأصولييهم للسنة المؤكدة باعتبار ماهيتها، وفيه مطلبان: المبحث الثاني: حكم ترك السنة المؤكدة عند فقهاء الحنفية وأصولييهم، وفيه مطلبان: المبحث الثالث: التطبيقات الفقهية للسنة المؤكدة عند الحنفية، وفيه ست مسائل. ومن النتائج التي توصل إليها الباحث: 1-أنّ مصطلح سنن الهدى الذي يتداوله الأصوليون لا يختص بمصطلح السنن المؤكدة الذي يتداوله الفقهاء؛ لأنه يدخل فيه الواجب بناءً على أنّه ثبت وجوبه بالسنة، وإلا فالسنة قسيم الواجب، وأما السنة المؤكدة فإنّ بعضها ما هو من شعائر الإسلام، أو ما هو قريب من الواجب، فيدخل في سنن الهدى، وبعضها دون ذلك. وأوصي الباحث بتتبع المصطلحات الأصولية مع المقارنة بالمادة الفقهية؛ لتحصل الملكة المقصودة من علم أصول الفقه، ولا سيما عند الحنفية رحمهم الله.

Abstract: Anyone who examines the books of principles and jurisprudence according to the Hanafi School, may God Almighty have mercy on them, will find in them some terms that require great contemplation and extensive scrutiny to reach its depths, and meanings, and by looking at their terminology, we find a term that has apparently been confused by researchers, namely: the term “The Compulsive Sunnah.” I wanted to follow this term by talking about its reality, its rulings, and its results according to the scholars of fundamentals of jurisprudence and the Hanafi jurists, may God have mercy on them. This research follows the applied inductive method. In it is the extrapolation of their definitions of this term, the most prominent rulings, with the application of it, and a statement of its benefits and results. The research consists of an introduction, three chapters and a conclusion. In the preface, I dealt with: the definition of the Sunnah, linguistically and technically, then the divisions of the Sunnah in general according to the Hanafi school, the difference between them, and the rulings built over them. The first chapter: the Hanafi jurists and their scholars of fundamentals of jurisprudence definition of the compulsive Sunnah, considering its essence, and has two topics: The second chapter: the ruling on leaving the compulsive Sunnah according to the Hanafi jurists and their scholars of fundamentals of jurisprudence, and it has two topics: The third chapter: the jurisprudential applications of the compulsive Sunnah according to the Hanafis, and it contains six issues. Among the findings of the researcher: 1- The term Compulsive Sunnah, which the scholars of fundamentals of jurisprudence circulate, is not specific to the term compulsive Sunnah, which the jurists circulate; Because the obligation is included in it based on the fact that it is proven that it is obligatory by the Sunnah, otherwise the Sunnah is a division of the duty. The researcher recommended following the terminology of fundamentals of jurisprudence while comparing it with the jurisprudence materials, to obtain the desired skills from the science of the principles of jurisprudence, especially according to the Hanafi School, May God have mercy on them.
