المستخلص: هذا بحثٌ مختصرٌ وإشارة وجيزة، تجمعُ وتوثّق جملةَ الفروق الفقهيّة والأصولية مما ذكره الإمامُ الشافعيّ -رحمه الله – في كتابه الرّسالة والتي تميزت بأسلوب الحوار والمناظرة في مجملها وأصّل فيها الشافعيّ كثيراً من أصول الاستنباط. يمهّدُ البحثُ بالفروقِ ومعناها في اللغة ثم معناها كعلمٍ مُستقلٍ عند الفقهاء، والمقصود بالفرقِ في اصطلاحِ الأصوليين ثم الفروق من خلال الرسالة. وأبرز ما توصل إليه البحثُ من نتائج أنّ الفرقَ مصطلحٌ مشترَك بين الفقهِ وأصول الفقه والمقصود به متشابه إلى حدٍّ ما، وقد حرص الإمامُ الشافعي إلى استعمال الفروق كثيراً تنبيها للسامع وتحريراً لرأيه وما ذهبَ إليه أحياناً، وردّاً على المخالف أحياناً أخرى. ومن الناحية الفقهيّة فأكثرُ الفروقِ الواردةِ في الرّسالة راجعةٌ إلى الخلاف بين مذهب الشافعيّة والحنفيّة، ثم تليها التي بين الشافعيّة والمالكيّة. ومن الفروق الأصولية التي أكثر الشافعيُّ الإشارة إليها في غير ما مسألة الفرق بين الرواية والشهادة لكثرة ما بُني على هذا الفرق من مسائل.

Abstract: This is a brief research and a concise innovative allusion that collects and documents a number of jurisprudential and fundamental dissimilarities from what Imam Al-Shafi’i mentioned - may Allah have mercy on him - in his book Al-Risalah, which was characterized by the style of dialogue and debate in its entirety, and Al-Shafi’i established many of the principles of inference in it. The research begins with an introduction to the concept of dissimilarities and its lexical meaning, then its meaning as an independent discipline among the jurists, and what is meant by the concept of dissimilarity in the terminology of the scholars of fundamentals of jurisprudence and then the concept of dissimilarities through the book Al-Risalah. The most prominent finding of the research is that the concept of dissimilarity is a common term between jurisprudence and the fundamentals of jurisprudence, and its significances are similar to some extent. Imam Al-Shafi’i was keen to use the concept of the dissimilarities a lot as an indication to the listener and elucidation of his opinion and his conviction, sometimes, and in response to the antagonist at other times. In terms of jurisprudence, most of the dissimilarities mentioned in the book Al-Risalah are due to the disagreement between the Shafi’i school of thought and the Hanafi school, then followed by that between the Shafi’i and the Maliki school. And among the fundamental dissimilarities that Al-Shafi’i referred to in numerous issues is the dissimilarity between narration and testimony due to the large number of issues based on this dissimilarity.
