المستخلص: يتناول هذا البحث مسألة من المسائلِ المهمة التي تعلّقت بمبحث الكليّات عند المنطقييّن، والمبادئ الأولى العامّة عند المتكلّمين، وتأثّرت بها مسائلٌ في أصول الفقه، وهي مسألةُ (الوجود الذّهنيّ والوجود الخارجيّ)،
و اشتمل البحث على مقدّمة ومدخلٍ في أهميّته وأسبابِ اختياره والدراسات السابقة، ثم ثلاثة مباحث وخاتمة:
المبحث الأول: مفهومُ الماهيّة و الوُجُود.
المبحث الثاني: أقسامُ الموجودِ والخلاف في ذلك.
المبحث الثالث: أبرزُ المسائلِ الأصوليّة المتعلّقة بــــــ" الوجود الذّهنيّ والوجود الخارجيّ".
وقد خلص البحث إلى جملة من الأمور أبرزها ما يلي:
- الموجود ينقسمُ باعتبار تحقُّقِهِ في الخارج وعَدَمِ تَحقُّقِه، إلى: ذهنيّ وخارجيّ.
- الوجودُ الخارجيّ لا خلافَ فيه عندَ المتكلّمين والفلاسفة، لأنّه الوجودُ الحقيقيُّ، ومحلّ الخلاف الوجود الذهنيّ.
- الماهيّة المجردة لا خلاف في أنها لا توجد في الخارج، و أمّا الماهية بشرط شيء من القيود، لا خلاف في وجودها في الخارج.
- جُلُّ المسائل اللغوية عند الأصوليين يعود الخلاف فيها إلى ما وضع اللفظ له أهو الوجود الذهنيّ أو الخارجيّ.
و أوصت الدراسة بمزيد البحث للمسائل المشتركة بين أصول الفقه وغيره من العلوم لا سيما التي بُنيت عليها أسباب الخلاف.
Abstract: This research deals with one of the important issues related to the topic of universals according to the logicians, and the first general principles of the theologians, and issues in the principles of jurisprudence were influenced by them, which is the issue of (mental existence and external existence),
It is divided into an introduction and synopsis to its importance, reasons for choosing it, and previous studies, then three chapters:
The first chapter: the concept of essence and existence.
The second chapter: types of existence and the disagreement on it.
The third chapter: the most prominent issues of principles of jurisprudence related to "mental existence and external existence".
The research arrived at several things, most notably:
- That the being is divided according to its external realization and its lack of realization, into mental and external.
- There is no disagreement between the theologians and philosophers on external existence, because it is the real existence, and the subject of disagreement is mental existence.
- There is no disagreement about the abstract quiddity in that it does not exist outside, and as for the quiddity on the condition of some restrictions, there is no disagreement in its existence outside.
- Most of the linguistic issues by the scholars of principles of jurisprudence go back to the intended meaning of the term, whether it is the mental or external existence.
The study recommended further research on the common issues between the principles of jurisprudence (Usul al-Fiqh) and other sciences, especially on which the causes of disagreement were built.
