المستخلص: يعتبر امتياز المرافق العامة عقداً إدارياً ذو طبيعة مختلطة يتعهد بمقتضاه أحد أشخاص القانون العام إلى أحد أشخاص القانون الخاص بمهمة إدارة وتسيير مرفق عام تحت إشرافه ورقابته، ويتكون هذا العقد من شروط تنظيمية تملك الإدارة المتعاقدة تعديلها بإداراتها المنفردة، وشروط تعاقدية لا تملك تعديلها إلا بالاتفاق مع المتعاقد، ويترتب على عقد الامتياز باعتباره عقداً إدارياً آثار قانونية، إذ يحدد حقوق والتزامات طرفيه وعلى الأخص حقوق والتزامات الملتزم (المتعاقد مع الإدارة) والإدارة المتعاقدة فضلاً عن الحقوق التي تتمتع بها والالتزامات التي تتحملها استناداً لقاعدة سير المرافق العامة بانتظام واطراد.

Abstract: Abstract A public utility concession is an administrative contract of a mixed nature whereby a person of common law undertakes to a person of private law to administer and operate a public facility under his or her supervision and control, consisting of regulatory terms, the modification of which is the responsibility of the contracting administration by its own individual administration, and contractual terms, the modification of which can only be undertaken by agreement with the contractor.The concession contract as an administrative contract has legal implications, defining the rights and obligations of its parties, in particular the rights and obligations of the obligor (management contractor) and the contracting administration, as well as the rights and obligations assumed by it on the basis of the regular and progressive functioning of public utilities.
