تناولت هذه الدراسة الرقابة القضائية على حكم التحكيم في ضوء نظام التحكيم السعودي. وذلك من خلال بيان مفردات الدراسة، بالتعريف بمفهوم الرقابة القضائية، وكذا مفهوم حكم التحكيم وأنواعه وميعاد صدوره والتفرقة بينه وبين الحكم القضائي. وبعد هذا المدخل للدراسة خصص الباحث مبحثًا لدراسة النوع الأول من الرقابة القضائية على حكم التحكيم من خلال دعوى بطلان حكم التحكيم، ثم عالج في مبحث ثان النوع الثاني للرقابة القضائية والمتمثل في الرقابة القضائية عن طريق تنفيذ حكم التحكيم.
Abstract:
The summary dealt with this study on judicial oversight of the arbitration ruling in the light of the Saudi arbitration system. This is through the statement of the vocabulary of the study, by defining the concept of judicial oversight, as well as the concept of arbitration, its types, its date of issuance and the distinction between it and the judicial ruling. After this introduction to the study, the researcher devoted a research to the study of the first type of judicial oversight of the arbitration judgement through the claim of nullity of the arbitration judgement, and then dealt with in a second research the second type of judicial oversight, namely judicial oversight through the implementation of the arbitration judgement.
