المستخلص: يجمعُ هذا البحث ما قيل في المنظومات الأصولية المختلفة من تعريفاتٍ لمصطلحات أصول الفقه التي ذُكِرت في بابِ "الحُكم الشرعيّ" متتبعاً تعريفات كتابٍ مهمٍ درجَ الأصوليّون على تدارُسِهِ وتدْريسه، وهو "روضةُ النّاظرِ وجنّة المناظر" لابن قدامة المقدسي (541 هـ 1146م- 620 هـ1223م)، ويهدف البحثُ إلى جمعِ المتفرّق، وتسهيل حفظ تلكم التعريفات على المتخصصين ودارسيّ علم أصول الفقه.
نظراً لطبيعةِ الموضوعِ فقد تضمّن البحثُ مقدّمةً في أهميّته وأسباب اختيارهِ، والدّراسات السّابقة ثمّ بايين تتلوهما خاتمة بأهمّ النتائج والتوصيات، ثم فهارسَ تسهّلُ الاستفادة منه، فجاء تقسيم البحث وفق الآتي:
البابُ الأول: التّعريفات في "الحكم الشرعيّ التكليفيّ".
البابُ الثاني: التّعريفات في "الحكم الشرعيّ الوضعيّ
وقد توصل البحث إلى إظهار المقارنة والاختلاف في الحدود والتعريفات في تعريف المصطلح الأصوليّ وكيف أثّر ذلك في اختيار النُّظّام -على مرّ عصورهم- للقيود والألفاظ، مستقصياً – ما أمكن – جُلّ ما وقف عليه الباحث من المطبوع نظماً في أصول الفقه.
Abstract: This research compiles the definitions of the terms of the principles of Islamic jurisprudence that were mentioned in the chapter on “The Islamic Ruling” as written in the various principles of Islamic jurisprudence poetry collection, this is by tracing the definitions in an important book, famously used for studying and teaching by the scholars of the principles of Islamic jurisprudence, it is the work of Ibn Qudāmah al-Maqdīsī (541 AH/1146 AD – 620AH/1223AD); "Rawdat al-Nazir wa-Jannat al-Munazir". The research aims to collect the dispersed poems and facilitate the memorization of these definitions for scholars and students of the principles of Islamic jurisprudence.
Due to the nature of the topic, the research included an introduction to its importance, reasons for choosing it, and previous studies, followed by two chapters, followed by conclusion with the most important findings and recommendations, then indexes that facilitate the content usage, so the research was divided according to the following:
Chapter One: definitions in the "mandatory Sharia law."
Chapter Two: definitions in the positive legal ruling
The research in its conclusion showed comparison and difference in the definitions and descriptions in the definition of the principles of Islamic jurisprudence term, and how this influenced the poets' choice – through the ages - of the attributes and words, investigating - as much as possible - the majority of what the researcher could find from the poetry publication in the principles of Islamic jurisprudence.
