بينَ "وَصيّته"، و "نَظمِه" ذو الوزَارتَينِ بنُ الخطيبِ أصوليّاً

المستخلص: هذا بحثٌ مختصرٌ يهدفُ لإبرازِ جهودِ العلاّمةِ الأديبِ المؤرّخِ لسان الدّين بن الخطيب، الشهير بذي الوزارتين(713هـ1313م-776هـ1374م) في أصول الفقه، وذلك من خلالِ استقراءِ عمَلينِ مُهمّين من إِنتاجهِ الفِكريّ وهما: وصيةٌ كتَبها لأولادِه ونصّ فيها على أصُولِ الفقه، والثاني: نظمٌ له في أصول الفقه، تمّ اقتباسُ شواهدَ منهُ نظراً لتلف نُسَخِهِ الخطيّة.
ونظراً لطبيعةُ الموضوع فقد رأيتُ أن يتضمّن البحثُ مقدّمةً في أهميّته وأسباب اختيارهِ، والدّراسات السّابقة ثمّ بايين تتلوهما خاتمة بأهم النتائج والتوصيات، ثم فهارسَ تسهّلُ الاستفادة منه، فجاء تقسيم البحث وفق الآتي:
البابُ الأول: ترجمةٌ موجزةٌ للسان الدين بن الخطيب.
البابُ الثاني: أصولُ الفقهِ في تراثُ لسان الدين بن الخطيب، وتحته مبحثان
وقد توصّلَ البحثُ إلى أنّ للسانِ الدّين بنِ الخَطيبِ عنايةٌ واهتمامٌ بأصولِ الفقهِ، وأنّ كتابَهُ " رقم الحلل" في التاريخ، ويختلفُ تماما عن "الحُلل المرقومة" فهو في أصول الفقه نَظم فيه" اللمع" للإمام أبي إسحاق الشيرازيّ ت476هـ"وأنّ إضافَتَهُ العِلميّة -رحمَهُ الله– لا تَتعدّى رَوْنَق العِبارة وسلاسَة النّظم.
Abstract: This is a concise study that aims to highlight the efforts of the literary scholar and historian Lisan-Deen Ibn Al-Khatib, popularly known as the Double Minister “Dhu- Wizarataen” (713 AH/1313 CE –776 AH/ 1374 CE) in the fundamentals of jurisprudence, through extrapolating two important works from his intellectual production, which are: A testament he wrote for his children in which he specifically instruct on fundamentals of jurisprudence, and secondly his poetry on fundamentals of jurisprudence. Evidences were extracted from it due to the damage of the written manuscript.
Due to the nature of the topic, I thought that the research should include an introduction to its importance, reasons for choosing it, previous studies, and then two chapters, followed by conclusion with the most important findings and recommendations, then indexes to facilitate it usage, so the research was divided according to the following:
The first chapter: a brief biography of Lisan-Deen Ibn Al-Khatib.
The second chapter: Fundamentals of jurisprudence in the work of Lisan-Deen Ibn Al-Khatib, and it has two topics:
The research has concluded that Lisan-Deen Ibn Al-Khatib had interest and attention for the fundamentals of jurisprudence, and that his book “Raqmu Al-Hulal” on history is completely different from “Al-Hulal Al-Marqumat” which is on the fundamentals of jurisprudence wherein he composed the “Al-Luma’h” of Imam Abu Ishaq Al-Shirazi 476 AH and that his scholarly contribution to it didn’t go beyond his aesthetical discourse and smooth poetry styles.
