يتحدث هذا البحث عبر المنهج (الاستقرائي التحليلي) عن مظاهر صيانة الشريعة الإسلامية للحكم القضائي عن كل ما يعيبه، وعن مظاهر تحصين الشريعة لحكم القاضي عن النقض، والتتبع، إلا في نطاق ضيق.
ويتنظم البحث في فصلين، الفصل الاول: في مظاهر صيانة الحكم القضائي، وفيه ثلاثة مباحث، والفصل الثاني: في مظاهر حصانة الحكم القضائي، وفيه خمسة مباحث.
ومن أبرز نتائجه : اهتمام الشريعة البالغ بحكم القاضي، سواءً من جهة صيانته عن الخطأ، أو من جهة حصانته وتقويته، وذلك لما لحكم القاضي من أهمية.
Abstract: Abstract
This research speaks through the method (inductive and analytical) about the aspects of Islamic Sharia’s maintenance of the judicial ruling about all that is wrong with it, and the aspects of Sharia’s fortification of the judge’s judgment on cassation and tracking, except in a narrow range.
The research is organized into two chapters, the first chapter: On the aspects of the maintenance of the judicial ruling, and it includes three investigations, and the second chapter: On the aspects of the immunity of the judicial judgment, and it includes five sections.
Among the most prominent of his results: Sharia’s keen interest in the judge’s judgment, whether in terms of preserving it from error, or in terms of his immunity and strengthening, because of the importance of the judge’s ruling.
