المستخلص: مدار هذا البحث هو دلالة مفهوم المخالفة في الاستدلال القانوني ، ولزم قبل الحديث عن ذلك التطرق لماهية دلالة مفهوم المخالفة في علم أصول الفقه من حيث التعريف بها وحجيتها وشروطها وأنواع القيود المرعية لاعتبارها؛ وذلك لأن هذه الدلالة هي إحدى الدلالات التي أقرها علماء أصول الفقه وأشبعوها بحثاً وترجيحاً ، فلزم الرجوع لمصدرها للاستقاء منه. ثم بعد ذلك انتقل البحث إلى تصورات شراح القانون لدلالة مفهوم المخالفة من حيث التعريف بها وحجيتها وبيان مكانتها في الاستدلال القانوني، مع محاولة الباحث الاستفادة مما قرره الأصوليون حول حجيتها وشروطها وأنواعها لوضع تصور قانوني لطبيعة دلالة مفهوم المخالفة وشروط تطبيقها المناسبة للاستدلال القانوني وبيان أنواع قيودها الأكثر وروداً في النصوص النظامية، مع بيان أمثلة من التطبيقات القضائية للاستدلال بمفهوم المخالفة في المحاكم السعودية.

Abstract: The subject of this research is the inference of divergent meaning in legal reasoning. Starting by reviewing the concept of divergent meaning in the science of principles of Islamic jurisprudence; due to the fact that this method brought to legal practice from there, where its well established by the scholars in terms of its definition, its validity, its conditions, and its types. Then moving to the perceptions of law scholar regarding this method of reasoning in terms of defining it, its validity, and clarifying its place in legal reasoning. Attempting to benefit from what the Islamic scholars have established about its validity, conditions, and types, to develop a legal conception of the nature of the divergent meaning and clarifying the required conditions for its application in legal reasoning, and to explain the types of its restrictions that most frequently mentioned in legal articles, showing some examples of judicial applications of this reasoning method in Saudi court.
