المستخلص: كانت مشكلة البحث التي تناولتها في رسالتي عن العلاقة بين قاعدة "العادة محكمة" وما يتفرع عنها من القواعد الفقهية ونظام الإثبات السعودي، وأثر هذه القواعد على هذا النظام، واستخدمت في هذه الدراسة المنهج الاستقرائي التحليلي؛ فتناولت هذه القواعد المؤثرة في نظام الإثبات، وذكرت صيغها ومعناها الإجمالي، وبينت مجال تطبيقها في الفقه الإسلامي، ثم بينت معنى فقرات ومواد النظام، وبينت وجه تأثير هذه القواعد على مواد وفقرات نظام الإثبات، وتوصلت إلى نتائج وهي؛ أن القواعد الفقهية لها أثر كبير على نظام الإثبات السعودي، وأن كثيرًا من مواد وفقرات نظام الإثبات صياغتها قريبة من صياغة القواعد الفقهية، وأن القاعدة الفقهية "العادة محكمة" وما يتفرع عنها، قد أثرت في مواد العرف والعادات تأثيرًا كبيرًا.

Abstract: The research problem of my thesis is the relationship between the Fiqh maxim: “Custom Is Authoritative” (Al-ʿAdah Muhakkamah) and the Fiqh rules branching out from it in the Saudi Evidence Law, and how these rules affect the Evidence Law. In this study, I adopt the inductive and analytical approach through which I examine the rules affecting the Evidence Law, delineate their formulas and overall meaning, and highlight the scope of their application to Islamic Fiqh. Further, I explain the meaning of clauses and articles of the Law, and demonstrate how these rules affect the articles and clauses of the Evidence Law. Among the significant findings of this research are: The Fiqh maxims have a major impact on the Saudi Evidence Law. The wording of many articles and clauses of the Saudi Evidence Law are quite similar to the wording of Fiqh maxims. The Fiqh maxim: “Custom Is Authoritative” and the Fiqh rules branching out from it have greatly influenced the articles pertaining to traditions and customs.
