المستخلص: يتناول هذا البحث بيان مسألة من المسائل المستجدة وهي: (استخدام تقنية الذكاء الاصطناعي في بعض المجالات (النقل، والطب، والتجارة) وحصول الضرر بها من موت الأنفس وتلف الأموال، وبيان صور التلف الحاصل بتلك التقنية وأنها حقيقة واقعة أم افتراض مع بيان حكمها الشرعي بتطبيق القواعد الفقهية على تلك الصور والمستجدات. والبحث مشتمل على مقدمة وتمهيد ومبحثين. أما المقدمة ففيها بيان أساب اختيار الموضوع والدراسات السابقة. والتمهيد فيه بيان القواعد بالفقهية المعلقة بالضمان وشرحها وتأصيلها. والمبحث الأول فيه التعريف بالذكاء الاصطناعي ومجالات استخدامه. والمبحث الثاني فيه بيان التلف الحاصل باستخدام تقنية الذكاء الاصطناعي وبيان حكمه الشرعي مع تطبيق القواعد الفقهية. وختمت البحث ببيان أهم النتائج المتوصل إليها من خلال البحث.

Abstract: This paper addresses a novel issues, which is: (The Usage of Artificial Intelligence in Some Areas (Transportation, Health, and Commerce) and the damages that comes with it, like: death and destruction of properties, and the explanation of the instances of the destructions that happens as a result of this technology and whether it is a reality or an imagination. In addition to the explication of their Sharī’ah ruling through the application of jurisprudential maxims on those instances and novel issues. The paper is made up of an introduction, a preface, and two titles: As for the introduction, it includes the research rationale, and the literature review. The preface includes the explanation of the jurisprudential maxims related to guaranty, its meaning and jurisprudential originating. The first topic includes the definition of artificial intelligence and the areas of its usage. The second topic includes the explanation of the damages that come with the use of artificial intelligence and their Sharī‘ah ruling, with the application of jurisprudential maxims. The research concludes with the highlight of the most important results reached through the research.
