المستخلص: مستخلص يعنى البحث بجمع ودراسة أسباب الاختلاف عند الإمام الشافعي رحمه الله من خلال كتاب الرسالة، وذلك بجمع نصوص الشافعي في هذه الأسباب، ومن ثم تقسيمها إلى كليات وترتيبها ترتيبا أصوليا قدم منها ما يتعلق بالسنة ثم ما يتلق بالناسخ والمنسوخ ثم دلالات الألفاظ، في ثماني مباحث كل مبحث اشتمل على سبب من أسباب الاختلاف . تم دراسة كل سبب من خلال نص الشافعي عليه ، ثم نص غير الشافعي على كونه سببا، ثم وجه كونه سببا مع التمثيل والدراسة وفق المنهج المعتمد ووفق ما تتطلبه طبيعة البحث . خلص الباحث لعدد من النتائج منها: أولا: علم أسباب الخلاف من العلوم المهمة للمجتهد عموما وللمفتي خصوصا . ثانيا: علم الخلاف من مميزات الشريعة إن وقع من أهله وفي محله وبشرطه . ثالثا: الإمام الشافعي هو أول من ضع لبنة هذا العلم في كتابه الرسالة من خلال ما ذكره من أسباب تضمنها هذا البحث . رابعا: مقولة إن أول من أشار وجمع أسباب الخلاف هو الإمام ابن حزم غير صحيحة على اطلاقها ، فما ذكره لا يخرج عما نبه عليه الشافعي رحمه الله . الكلمات المفتاحية:( الشافعي ، الرسالة ، أسباب ، الاختلاف )

Abstract: The research aims at collecting and studying the Reasons for the disagreement according to Al-Imam Al-Shafi’i, may Allah have mercy on him, through the book Ar-Risaalah, by collecting the texts of al-Shafi’i on these reasons, and then dividing them into entireties and arranging them according to the principles of jurisprudence order from which he presented what is related to the Sunnah, then what he receives with the copyist and the abrogated and then the semantics of the words, in eight investigations each Study included one of the reasons for the disagreement. Each reason was studied through the text of Al-Shafi’i on it, then the non-Shafi’i stated that it was a reason, then he directed that it was a reason by citing example and study according to the approved method and according to the nature of the research. The researcher concluded with a number of results, including: First: Knowledge of the reasons of the disagreement is one of the important sciences for the mujtahid (qualified scholar) in general and the mufti in particular. Second: Knowledge of disagreement is one of the characteristics of the Sharia if it occurs from its people, its place, and by conditions. Third: Al-Imam Al-Shafi’i was the first to lay the foundation of this knowledge in his book Ar-Risalah, through what he mentioned of the reasons included in this research. Fourth: The saying that the first person to refer and collect the reasons for the disagreement is Al-Imam Ibn Hazm is not correct at all, what he mentioned does not deviate from what Al-Shafi'i, may Allah have mercy on him, pointed out.
