المستخلص: يتناول هذا البحث الأحكام المتعلقة بالضمان الابتدائي في العقود الإدارية وفقاً لنظام المنافسات والمشتريات الحكومية ولائحته التنفيذية، دراسة تحليلية تطبيقية، ويهدف البحث إلى بيان ماهية الضمان الابتدائي وأهميته وشروطه، وكذلك تحديد الوضع القانوني لسلطة الجهة الحكومية في فرضه من عدمه، وكذلك حقها في تمديد مدة سريانه أو مصادرته، وكذلك حق المتقدم بعطائه في إرجاع قيمته له أو تمديد مدة سريانه، كما يهدف إلى إيجاد وسائل تقوم مقام خطاب الضمان البنكي أكثر فاعلية وسرعة، وكذلك في أن يكون مرجعاً فيما يتعلق بالضمان الابتدائي لكلٍ من الجهة الحكومية عندما ترغب في طرح مشاريعها للمنافسة، ولكل شخص يرغب في التقدم بعطائه للدخول في منافسات الجهات الحكومية. واستخدمت في بحثي هذا المنهج التحليلي والتطبيقي، وقسمته إلى مقدمةٍ وتمهيدٍ وأربعة مباحث وخاتمة؛ أما التمهيد فهو يحتوي على بيان مصطلحات البحث، وذلك ببيان مفهوم الضمان الابتدائي وأهميته وشروطه؛ والمبحث الأول يحتوي على الأحكام المتعلقة بتقديم الضمان الابتدائي من بيانٍ لكيفية تقديمه، والحالات التي يجب فيها تقديم الضمان والحالات التي لا يجب فيها تقديمه، وكذلك الجهات المعفاة من تقديم الضمان الابتدائي؛ وأما المبحث الثاني فإنه يحتوي على الأحكام المتعلقة بإرجاع الضمان الابتدائي إلى أصحابه، مع ذكر تطبيقات قضائية على ذلك؛ وأما المبحث الثالث فهو يحتوي على الأحكام المتعلقة بتمديد الضمان الابتدائي، مع ذكر تطبيقات قضائية على ذلك؛ وأما المبحث الرابع فهو يحتوي على الأحكام المتعلقة بمصادرة الضمان الابتدائي وحالاته وخصائصه، مع ذكر تطبيقات قضائية على ذلك؛ وأما الخاتمة فهي تشتمل على أهم النتائج والتوصيات التي توصلت إليها في البحث، ومن أهمها إيجاد نظام دفع إلكتروني للضمان الابتدائي، وكذلك اعتبار الشيك المصدق كوسيلة ضمان ابتدائي.

Abstract: This research discusses the rulings related to initial guarantee in administrative contracts according to the law of government competitions and procurement and its executive regulations, and the research aims at explaining the nature of initial guarantee and its importance and its conditions, and identifying the legal status of the authority of the governmental body in imposing it or not, and its right in extending its validity or invalidity period, likewise, the right of the applicant with his bid to return its value to him or extend its validity period, and it also aims to find means that take the place of a letter of bank guarantee that is more effective and fast, as well as to be a reference in relation to the initial guarantee for each of the government agencies when they want to put their projects up for competition, and for every person who wishes to submit his bid to enter the competitions of government agencies. In my research, I used the analytical and applied method, and divided it into an introduction, a preface, four topics and a conclusion. As for the preamble, it included the highlight of the research terminologies, by clarifying the concept of the initial guarantee, its importance and its conditions. The first topic contained the rulings related to the provision of the initial guarantee, including the explanation of how to provide it, the cases in which the guarantee must be provided and the cases in which it is not mandatory to provide it, as well as the bodies exempted from providing the initial guarantee. As for the second topic, it contained the rulings related to retuning of the initial guarantee to its owners, with a mention of judicial applications on this. As for the third topic, it contained rulings related to the extension of the initial guarantee, with a mention of judicial applications to that. As for the fourth topic, it contained the rulings related to the invalidation of the initial guarantee, its cases and characteristics, with a mention of judicial applications to that. As for the conclusion, it contained the most important findings and recommendations that were reached in the research, the most important of which is the production of an electronic payment system for the initial guarantee, as well as considering the certified check as a means of initial guarantee.
