المستخلص: جاء هذا البحث لبيان أثر جائحة فايروس كورونا المستجد(COVID-19)على عقود الإجارات وكان منهج البحث "وصفي – تحليلي" من خلال قاعدة وضع الجوائح، وانتظم في البحث في تمهيد وثلاثة مباحث، فجعلته الكلام فيه عن قاعدة وضع الجوائح وأنواع، وأحكام الجوائح التي تلحق عقد الإجارة سواء على العين المؤجرة، أم على العاقدين، ثم ختمت الكلام على أثر الجائحة على الإجارة المنتهية بالتمليك، وخاتمة مبينا فيها أهم النتائج.ومن أهمها ثبوت الفسخ للمستأجر؛ بسبب الجائحة العامة. أن العلاقة بين وضع الجوائح، ونظرية الظروف الطارئة علاقة عموم، وخصوص مطلق.

Abstract: The purpose of this research was to determine the effect of the new Coronavirus pandemic (COVID-19) on lease contracts. The research method was "descriptive-analytical" through the rule of establishing pandemics, and the research was organized in a preamble and three topics, so I made it talk about the rule of establishing pandemics, types, and provisions of pandemics. Which is attached to the lease contract, whether on the leased property or on the two contracting parties and then concluded the speech on the impact of the pandemic on the lease ending with ownership, as well as a conclusion indicating the most important results. As a result of the widespread pandemic . The relationship between the situation of pandemics and the theory of emergency conditions is a relationship of generality and absolute specificity.
